MARIN BAY IMPROVEMENT DISTRICT NO. 1
RESOLUTION NO. 26,5 7
RESOLUTION ORDERING CIIANGES IN ACQUISITIONS
WHEREAS, the City Council of the City of San Rafael,
State of California, heretofore by Resolution No. 2441 adopted
on the 23rd day of January, 1961 ordered the acquisition of
drainage facilities within Marin Bay Improvement District No. 1
including pipes, drainage channels, lagoons, dykes, and ease-
ments for lagoons, channels and flooding; and
WHEREAS, there has heretofore been acquired pursuant
to said Resolution No. 2441 a certain dyke easement; a certain
flooding easement and a certain drainage easement within the
boundaries of said Marin Bay Improvement District No. 1; and
WHEREAS, the City Council has determined that it is
to the best interests of said Marin Bay Improvement District No.
1 to order that the acquisitions of said easements be changed
and modified to provide that the real property subject to said
easements be reduced in area; and
WHEREAS, moneys have been paid from the improvement fund
of Marin Bay Improvement District No. 1 for the acquisition of
said easements; and
WHEREAS, the City Council of the City of San Rafael,
State of California, by motion adopted at a regular meeting held
on Monday, the 2nd day of July, 1961, at 8:00 p.m. (P.S.T.) pro-
vided for a hearing on said changes in acquisitions to be held
on Monday, the 16th day of July, 1962, at 8:00 p. -m. (P.S.T.) in
the Council Chambers of said City Council, City Hall, City of
San Rafael, California, and provided for notice of said hearing;
and

WHEREAS, notice of said hearing was duly given in the
manner required by law and said hearing was duly held at said
time and place; and
WHEREAS, no person appeared before said City Council to
show cause why said changes should not be ordered and no written
objections to said changes were delivered to the City Clerk up
to the hour set for said hearing and the City Council has acquired
jurisdiction to order said changes made,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SAN RAFAEL, STATE OF CALIFORNIA, as follows:
1. The Mayor and the City Clerk of the City of San
Rafael, State of California, are authorized and empowered to exe-
cute for and on behalf of the City of San Rafael, State of California,
a Deed of Abandonment of Easement in favor of the owners of record
of that portion of the flood easement, heretofore acquired for
Marin Bay Improvement District No. 1, which portion is more parti-
cularly described upon the attached Exhibit A by metes and bounds
and to deliver said deed to the owners of record upon the condition
that there shall be paid to the City Treasurer of the City of San
Rafael for the account of Marin Bay Improvement District No. 1
that proportion of the total acquisition cast for said flooding
easement which the property herein authorized to be abandoned of
the easement bears to the entire property acquired for the purposes
of said easement, to wit, the sum of $8,632.50.
2. The Mayor and the City Clerk of the City of San
Rafael, State of California, are hereby authorized and empowered
to execute a Deed of Abandonment of Easement abandoning to the
record owner that portion of the drainage easement heretofore
acquired for Marin Bay Improvement District No. 1, which portion
is more particularly described by metes and bounds on the attached
Exhibit B, and to deliver said Deed of Abandonment to the owners
of record upon the condition that there shall be paid to the City

Treasurer of the City of San Rafael for the account .of Marin Bay
Improvement District No. 1 that proportion of the acquisition
cost of said drainage easement which the property herein author-
ized to be abandoned of easement bears to the entire property
acquired for drainage easement purposes, to wit, the sum of $940.00.
3. The Mayor and the City Clerk of the City of San Rafael,
State of California, are hereby authorized and empowered to execute
a Deed of Abandonment of Easement of that portion of the dyke main-
tenance easement heretofore acquired for Marin Bay Improvement
District No. 1, which portion is more particularly described by
metes and bounds upon the attached Exhibit C, and to deliver a
Deed of Abandonment to.the owners of record of the property with-
out the condition of the payment of money to the City Treasurer
of the City of San Rafael for the account of Marin Bay Improvement
District No. 1.

San Rafael, State of California, this 16th day of July, 1962,by
