RESOLUTION NO. 26 71�
RESOLUTION AUTHORIZING DISTRIBUTION OF SURPLUS
WHEREAS, The Council of the City of San Rafael, St to
of California, heretofore on August 6, 1962 by notion duly
adopted aceepted the acquisitions and works of ._ -.c_nt
provided to be installed and acquired in the City of Ban Rafael
and in the County of Marin in an assessment di.,trict designated
"Maria Bay Improvement District No.l"q and
WHEREAS, The Superintendent of Streets of the City has
duly published a Notice of ComyAetion of all the works of
improvement so provided to be installed and acquired in the
manner provided by law= and
wExREAS, all claims for incidental expenses, contractors'
claims and claims for acr•, ition:s have been paid and there are
presently no claims made or pending against said district and
the time provided by lave within which to file claims again. -,t

WHEREAS, it is provided by Resolution No. 2441 of tiieCity
Council of the City of San Rafael that surplus in the improve-,
meet fund for said Marin Bay Improvement District No. 1 be re. --
funded or credited pro rata to the parties assessed in accord-
ance with Section 10427 of the Streets and Highways Code of the
State of Californias and
WHMMAS, there is presently in the improvement fund for

NMT, THERBFORL, BE IT RESOLVED BY TSE COUNCIL OF THE CITY
OF SAN RAFAEL, STATE OF CALIFOP� IS, Poll-_ s
1. City Treasurer and the. City Cl of th City of

San Rafael are authorized and directed upon the adoption of
this Resolution to pay or to credit pro rata to the owners
of the lands assessed within Marr gay Improvement District
No. 1 as such owners appear from the last equalised assessment
rale the present surplus in the imrovement fund for said
district as provided in Section 10429 of the Streets and
Highways Code.
PASSED AND ADOPTED this ISth day of October, 1962, by the
following votes
