RESOLUTION AND ORDER ADOPTING ENGINEER'S REPORT AND ORDERING
THE CONSTRUCTION AND ACQUISITION OF CERTAIN 1MI ROVEIEN`I'S AND
RIGHTS OF WAY IN CHULA VISTA ASSESSMENT DISTRICT, CITY OF
S,' -'N RAFAEL, NIARIN COUNTY, CALIFORNIA
WHEREAS on the 6th day of august, 1962 the City Council
of the City of San Rafael Marin County California pursuant to the
provisions of the Municipal Improvement Act of 1913, adopted its
Resolution of Intention No. 2647 for the construction and acquisi-
tion of certain improvements and rights of way in Chula Vista Assess-
ment District, City of San Rafael, Marin County, California,, and
referred said improvements and acquisitions to the Engineer of Work
of said assessment district; and
WHEREAS, said City Council directed that said Engineer of
Work make and file with the City Council of the City of San Rafael
their report in accordance with the provisions and requirements of
the Municipal Improvement Act of 1913 of the State of California; and
W�=EAS, said Engineer of Work did, on the 19th day of
Novemb�:_:, 1962, file with the City Clerk of the City of San Rafael
their report in accordance with said resolution, and said City Clerk
has presented said report to this City Council for consideration;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of San Rafael, and this City Council hereby finds:
1. That the report made and filed by the Engineer of Work
of Chula Vista Assessment District, City of San Rafael, Marin
County, California, on November 19, 1962, contains all of the re-
quirements provided for said report by the provisions of the
Municipal Improvement Act of 1913, including (1) estimate of cost;
(2) assessment diagram and assessment; (3) specifications; (4) plans
and profiles; (5) descriptions of easements to be acquired.
2. That said report, and each and every part thereof, is
sufficient in every particular, and it is hereby determined and
directed that said report shall stand as the report for all sub-
sequent proceedings under said Municipal Improvement Act of 1913; and
BE IT FURTHER RES OLE VED that Monday, the 7th day of
January, 1963, at the hour of 8:00 o'clock P.M. of said day, at
the^ meeting place of the City Council of the Citv of San Rafael,
located in'the City Nall, San Rafael, California, is hereby fixed
by this City Council as the time for hearing protests with relation
to the proposed acquisitions and improvements as described in said
report; that any person interested in objecting to said acquisitions
and improvements, the extent Of the assessment district, the assess-
ment, or the engineers estimate of the cost and expenses, or any
other actor determination of the City Council of the City of
San Rafael, or the Engineer of Work of Chula Vista Assessment
District, may file protest in writing with the City Clerk of the
City of San Rafael at or before the hour herein fixed for hearing
thereon; and
BE IT EI;RTIIER RESOLVED that the City Clerk of the City of
San Rafael be, and he is hereby, directed to publish a Notice of
Improvement pursuant to Section 6066 of the Government Code of the
State of California, the first of which said notices is to be first
published at least twenty (20) days prior to the date herein set
for hearizng of protests; and
BE 1T FURr E-IER RESOLVED that the Engineer of Work of Chula
Vista Assessment District be, and he is hereby, directed to cause
notices of the passage of this resolution to be posted on all of
the open streets within the district described in the Resolution of
Intention at not more than three hundred feet apart on each street
so posted, in accordance with the requirements of Section 10302 and
10303 of the Municipal Improver:.ent Act of 1913; and
BE IT FURTHER RESOLVED that notices of the adoption of the
Resolution of Intention and filing of the Engineer's Report shall
be mailed, postage prepaid, to all persons owning real property
proposed to be assessed whose names and addresses appear upon the
last equalized assessment roll for taxes or as known to the City
Clerk. Said notices shall contain the matters -required in Section
10,307 of the Municipal Improvement Act of 1913 of the State of
California.

I HEREBY CERTIFY that the foregoing resolution was duly
and regularly adopted by the City Council of the City of San Rafael,

Marin County, California, at a regular meeting thereof, held on
the 19th day of November, 1962, by the following vote, to wit:
