RESOLUTION FINDING AND DETERMINING THAT PUBLIC
INTEREST AND NECESSITY REQUIRES THE CONSTRUCTION
OF AN EXTENSION OF THIRD STREET WESTERLY FROM
E STREET TO SECOND STREET, IN SAN RAFAEL, AND
THAT THE ACQUISITION OF THE PROPERTY HEREIN
DESCRIBED IS__NECESSARY THEREFOR.
BE IT RESOLVED that public interest and necessity
require the construction of an extension to Third Street in the
City of San Rafael, from its present terminus at E Street, west-
erly so as to join it with the easterly terminus of Minnie Street,
at Shaver Street, and the widening and extension of Minnie Street
to its intersection with Second Street, a - -
ffE_ .
BE IT FURTHER RESOLVED that the fee title to the follow-
ing described property is necessary for the construction of said
street improvement, and the City Attorney for the City of San
Rafael is hereby authorized and directed to institute suit in the
name of and on behalf of the said city to acquire, under the power
of eminent domain, title to the said property for purposes of said
public improvement.
That certain real property situate in the City of San
Rafael, County of Marin, State of California, described
as follows:
BEGINNING at a point in the northern line of the right
of way of the North Shore Railroad Company which right
of way is now included in and forms a part of a public
highway in the City of San Rafael known as West End Avenue
which said point of beginning is distant southeasterly
350 feet measured thereon from the point of intersection
of said line of said right of way with the easterly line
of "G" Street extended southerly running thence from said
point of beginning southeasterly along said line of said
right of way 135 feet, more or less, to the lands of S.T.
Desimone; running thence north 7025' west 67.7 feet; thence
north 139 west 42.5 feet; thence north 25030' west 47.3
feet; thence northwesterly along the center of the creek
which forms the northerly boundary of the lands of David
Warden about 40 feet to a point which is in a line drawn
at right angles to the line of the right of way heretofore
mentioned through the point of beginning herein; thence

south 24026' west about 125 feet to the point of
beginning.
ADOPTED this 17th day of December 1962 by the
following vote:
AYES: Aby, Barr, Jensen, Menary and Mayor McInnis.
NOES: None
ABSENT: None
