HomeMy WebLinkAboutCC Resolution 2748RESOLUTION NO. �?`C A RESOLUTION APPOINTING ENGINEER AND ATTORNEYS NORTHGATE INDUSTRIAL PARK, UNIT ONE RESOLVED, by the City Council of the City of San Rafael, California, that WHEREAS, this Council has determined to undertake proceedings pursuant to appropriate special assessment and assessment bond acts for the acquisition and construction of improvements in said City; WHEREAS, the public interest and general welfare will be served by appointing and employing engineers and attorneys for the preparation and conduct of said proceedings and work in connection with said acquisitions and improvements. NOW, THEREFORE, IT IS ORDERED, as follows: 1. That Carlos E. Gonzalez, San Rafael, California, be, and he is hereby, appointed as Engineer of Work and employed to do and perform all engineering work necessary in and for said proceedings, including all preliminary surveying, preparation of report, plans, profiles, specifications, estimate of costs, diagram, assessment, setting grade stakes, supervision of work, preparing, signing and filing the list of unpaid assessments and cost certificates, and that compensation therefor be fixed at reasonable fees to be set forth in the estimate of cost and approved by the City Council. 2. That the City Engineer be authorized and directed to examine and approve all engineering documents and to provide the inspection of the installation of said improvements usual for his office to provide in subdivisions. 3. That the law firm of Wilson, Harzfeld, Jones & Morton, San Mateo, California, be appointed and employed to do and per- form all legal services required in the conduct of said proceed- ings, and that their compensation be fixed at customary fees to be set forth in the estimate of cost and approved by the City Council. 4. That all of the fees provided to be paid in para- graphs 1 and 3 hereof be assessed as an incidental expense of the proceedings and be not payable otherwise by the City; and that all fees, costs and expenses of the City Engineer provided for in paragraph 2 hereof, incurred prior to such time as funds are available in said proceedings, shall be advanced to the construction fund for said project by the petitioners in cash, subject to reimbursement upon the availability of proceeds of sale of assessment bonds herein. I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the City Council of the City of San Rafael, California, at a meeting thereof held on the day of 2L4�� 1963, by the following vote of the members thereof: AYES, and in favor thereof, Councilmen: Aby, Baar, Jensen, Menaq and Mayor McInnis NOES, Councilmen: ABSENT, Councilmen; W.
