RESOLUTION AMENDING RESOLUTION NO. 2637
WHEREAS, the City Council of the City of San
Rafael, State of California, heretofore by Resolution No. 2637,
adopted on the 16th day of July, 1962, authorized the Mayor
and the City Clerk of the City of San Rafael, State of
California, to execute a Deed of Abandonment of Easement
covering certain real property described upon Exhibit A to
said Resolution No. 26377 and
WHEREAS, the consideration to be paid for the
execution of the said Deed of Abandonment was stated to be
$8,632.50; and
WHEREAS, Exhibit A attached to said Resolution
No. 2637 does not fully describe the area of real property
intended to be covered by the effect of said Resolution
No. 2637,- and
WHEREAS, Exhibit C attached to said Resolution
No. 2637 does not fully describe the area of real property
intended to be covered by the effect of said Resolution
Nom 2637; and
WHEREAS, the amendment to Exhibit A as shown on
said Resolution No. 2637 provided for in this Resolution
will increase the area of real property otherwise covered
by the effect of said Resolution No. 2637 by an aggregate
amount of 0.71 acres thus increasing the sum payable to the
City Treasurer of the City of San Rafael, for the account of
Marin Bay Improvement District No. 1 by the su-rq of $532.50; and

WHEREAS, the amendment of the legal description
attached as Exhibit C to said Resolution No. 2637 will not
affect the sum payable to the City Treasurer of the City of
San Rafael, for the account of Marin Bay Improvement District
No. 1 as provided in said Resolution No. 2637;
NOW THEREFORE, BE IT RESOLVED -BY THE CITY COUNCIL
OF THE CITY OF SAN RAFAEL, STATE OF CALIFORNIA, as follows:
1. That portion of Exhibit A to Resolution
No. 2637 of the City Council of the City of San Rafael,
State of California, which contains the legal description
attached to this resolution as Exhibit A is amended by the
substitution therefore of the legal description attached to
this resolution marked as Exhibit B.
2® Resolution No. 2637 is further amended to
provide that Exhibit A to said resolution should be added to
and enlarged by the legal description attached to this
resolution marked as Exhibit C.
3. Resolution No. 2637 of the City Council of
the City of San Rafael, State of California, is amended in
the manner that the legal description attached to said
Resolution No® 2637 marked as Exhibit C shall be supplanted
and replaced by the legal description attached to this
resolution marked as Exhibit D.
4. Resolution No. 2637 of the City Council of
the City of San Rafael, State of California, is amended by
the addition of the sum of $532.50 to the sum of $8,632.50
appearing in paragraph 1 of said Resolution No® 2637 where-
upon the figure appearing in said paragraph 1 is amended to
read $9,165.00®

5® The Mayor and the City Clerk of the City
of San Rafael, State of California, are hereby authorized
and empowered to execute a Deed of Abandonment of Easement
abandoning to the record owner of the real property that
portion of the drainage easement described in said Resolution
No. 2637 as amended by this resolution upon the condition
that there should be paid to the City Treasurer of the
City of San Rafael, the sum, stated in paragraph 1 of
said Resolution No. 2637 as amended by this resolution.

County of Marin, State of California, described as follows:
BEGINNING at a point which bears South 750 021 03" East,
122.49 feet and East, 404.08 feet from the most northerly
corner of that certain parcel of land described in the
deed from Stegge Development Co., a corporation, to
Montgomery Farms, a co -partnership, recorded November 15,
1955 in Book 986 of official Records at page 5268 Marin
County Records; thence northerly on a curve to the right,
whose center bears North 730 54' 16" East, having a
radius of 395 feet, a central angle of 480 501 44", an
arc distance of 336.74 feet; thence North 320 45' East,
380.00 feet; thence on a curve to the left, tangent to
the preceding course, having a radius of 505 feet, a
