RESOLUTION MODIFYING THE DECISION, DETERMINATION OR
REQUIREMENT OF THE PLANNING COMMISSION OF THE CITY
OF SAN RAFASL IN CONNECTION WITH THE THREE -LOT SUB-
DIVISION OF HARRY KIRSNER OF PARCEL NO. 12-023-06
LOCATED ON SPRING GROVE AVENUE AND HILLSIDE AVENUE
WHEREAS, the Planning Commission of the City of San Rafael, on
the 22nd day of October 1963, approved that certain three -lot subdivision
of Parcel No. 12-023-06 submitted by Harry Kirsner and imposed certain
conditions in connection with such subdivision;
And whereas, the matter came on regularly for hearing on appeal
before the City Council of the City of San Rafael on the l8th day of
November 1963;
And whereas, evidence, both oral and documentary, was produced;
And good cause appearing therefor;
NOW, THEIREF&E, IT IS RESOLVED as follows:
1. That the decision of the Planning Commission of the City of
San Rafael is hereby affirmed, except that the requirements or conditions
of said decision are hereby modified so that they read as follows:
(a) A copy of the agreement to extend the water main as
required shall be submitted to the Planning Commission before any
building permits are issued for development of the proposed to fronting
on Hillside Avenue;
(b) Water line extensions to be required to the proposed lot
fronting on Hillside Avenue;
(c) As and when the proposed lot fronting on Hillside Avenue
is improved, curbs and gutters shall be constructed along Hillside Avenue
in front of this proposed lot, at the time of and as a condition to the
issuance of any building permit. The location of such curbs and gutters
shall be determined by the City Engineer.
(d) As a condition precedent to the issuance of any building
permit or improvements on the proposed lot fronting on Hillside Avenue, a
bond, in an amont uto be determined by the City Engineu
er, to insre the
installation of curbs and gutters on Hillside Avenue in front of this
proposed lot, shall be posted with the City of San Rafael.

Upon the request of Mr. David Menary, Jr., City Attorney, I am enclosing corrected
copies of a resolution modifying the decision, determination or requirement of the
Planning Commission of the City of San Rafael in connection with the 3 lot subdiv-
ision of Harry Kirsner of Assessor's Parcel No. 12-023-06 located on Spring Grove
Avenue and Hillside Avenue. This matter is in connection with Item 5 on Agenda
for the City Council Meeting of November 18, 1963. 7

WHEREAS, the Planning Commission of the f Sacs Rafael,
