HomeMy WebLinkAboutCC Resolution 2906RESOLUTION NO. 2906 RESOLUTION ORDERING REMOVAL OF POLES AND OVERHEAD WIRES AND ASSOCIATED OVERHEAD STRUCTURES FROM UNDERGROUND UTILITY DISTRICT WHEREAS, a public hearing was held by the City Council of the City of San Rafael on the 2nd day of December, 1963, and regularly continued for further hearing to the l6th day of December 1963, to ascertain whether the public necessity, health or safety requires the removal of poles and overhead wires and associated overhead structures in that certain Underground Utility District hereinafter described; and WHEREAS, notice of said public hearing was given as required by law; and WHEREAS, the Council of the City of San Rafael, State of California, finds that the public necessity, health and safety require the removal of poles and overhead wares and associated overhead structures as defined in Ordinance 780 of the City of San Rafael, State of California, in the Underground Utility District hereinafter described; NOW, THEREFORE, it is resolved as follows: 1. That the public necessity, health and safety require the removal of poles and overhead wires and associated overhead structures, including poles, towers, supports, wires, conductors, guys, stubs, platforms, crossarms, braces, transformers,insulators, cut-outs, switches, communication circuits, appliances, attachments and appurtenances located above ground and used or useful in supplying electric, communication, or similar or associated service in that certain Underground Utility District in the City of San Rafael, State of California, described as follows; PARCEL 4 That portion of Third Street described as beginning at the intersection of the center line of Union Street with the center line of Third Street and running thence easterly along the center line of Third Street a distance of 1,300 feet. 2. That is hereby ordered that all poles and overhead wires and associated structures, as defined in Ordinance 780 of the City of San Rafael, State of California, including the items described above in subparagraph I of this Resolution, that are within the above described Underground Utility District, be removed on or before the est day of December, 1964, and all property owners which are affected by the within order shall be ready to receive underground service on or before said date. 3. Within ten (10) days of the passage of this Resolution, the City Clerk of the City of San Rafael, California, shall notify all affected utilities and all persons owning real property within the Underground Utility District above described of the adoption of the within Resolution, and shalt further notify said property owners of the necessity that if they, or any person occupying such property, desire to continue to receive electric, communication or other similar or associated service, they or such occupant shall provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California, and to the requirements of the laws of the State of California and of the City of San Rafael, California. 4. The Clerk of the City of San Rafael, California, shall give the notification required above by mailing a copy of the within RESOLUTION ORDERING REMOVAL OF POLES AND OVERHEAD WIRES AND ASSOCIATED OVERHEAD STRUCTURES FROM UNDERGROUND UTILITY DISTRICT, together with a copy of Ordinance 780 of the City of San Rafael, California, to the affected utilities and to the affected property owners as such are shown on the last equalized tax roll of the County of Marin, State of California. i, W.
