RESOLUTION ORDERING REMOVAL OF POLES AND OVERHEAD WIRES
AND ASSOCIATED OVERHEAD STRUCTURES FROM UNDERGROUND UTILITY
DISTRICT, BOUNDED BY THIRD STREET, FOURTH STREET, LOOTENS
PLACE AND CIJOS STREET.
WHEREAS, a public hearing was held by the City Council of the City of
San Rafael on the /day of 1964 to ascertain
whether the public necessity, health or safety requires the removal of poles
and overhead wires and associated overhead structures in that certain "Under-
ground Utility District" hereinafter described; and
WHEREAS, notice of said public hearing was given as required by law; and
WHEREAS, the Council of the City of San Rafael, State of California,
finds that the public necessity, health and safety require the removal of poles
and overhead wires and associated overhead structures as defined in Ordinance 780
of the City of San Rafael, State of California, in the "Underground Utility District"
hereinafter described;
NOW, THEREFORE, it is resolved as follows:
1. That the public necessity, health and safety require the removal of
poles and overhead wires and associated overhead structures, including poles,
towers, supports, wires, conductors, guys, stubs, platforms, crossarms, braces,
transformers, insulators, cut-outs, switches, communication circuits, appliances,
attachments and appurtenances located above ground and used or useful in supplying
electric, communication, or similar or associated service in that certain "Under-
ground Utility District" in the City of San Rafael, State of California, described
as follows:

2. That it is hereby ordered that all poles and overhead wires and
associated structures, as defined in Ordinance 780 of the City of San Rafael,
State of California, including the items described above in subparagraph 1 of
this Resolution, that are within the above described "Underground Utility District",
be removed on or before the 4day of 196 and all
property owners which are affected by the within order shall be ready to receive
underground service on or before said date.
3. Within ten (10) days of the passage of this Resolution, the City
Clerk of the City of San Rafael, California, shall notify all affected utilities
and all persons owning real property within the "Underground Utility District"
above described of the adoption of the within Resolution, and shall further
notify said property owners of the necessity that if they, or any person occupy-
ing such property, desire to continue to receive electric, communication or other
similar or associated service, they or such occupant shall provide all necessary
facility changes on their premises so as to receive such service from the lines
of the supplying utility or utilities at a new location, subject to applicable
rules, regulations and tariffs of the respective utility or utilities on file
with the Public Utilities Commission of the State of California, and to the
requirements of the laws of the State of California and of the City of San Rafael,
California.
4. The Clerk of the City of San Rafael, California, shall give the
notification required above by mailing a copy of the within RESOLUTION ORDERING
REMOVAL OF POLES AND OVERHEAD WIRES AND ASSOCIATED OVERHEAD STRUCTURES FROM
UNDERGROUND UTILITY DISTRICT, BOUNDED BY THIRD STREET, FOURTH STREET, LOOTENS
PLACE AND CIJOS STREET, together with a copy of Ordinance 780 of the City of
San Rafael, California, to the affected utilities and to the affected property
owners as such are shown on the last equalized tax roll of the County of Marin,
State of California.

hereby certify that the foregoing Resolution was duly and regularly introduced
and adopted,at a Regular meeting of the Council of said City held on the
