RESOLUTION AUTHORIZING DISTRIBUTION OF SURPLUS WHEREAS, The Council of the City of San Rafael, State of California, heretofore on August 6, 1962 by motion duly adopted accepted the acquisitions and works of improvement provided to be installed and acquired in the City of San Rafael and in the County of Marin in an assessment district designated "Marin Bay Improvement District No. 1"; and WHEREAS, The Superintendent of Streets of the City has duly published a Notice of Completion of all the works of improvement so provided to be installed and acquired in the manner provided by law; and WHEREAS, all claims for incidental expenses, contractors' claims and claims for acquisitions have been paid and there are presently no claims made or pending against said district and the time provided by law within which to file claims against said district has expired; and WHEREAS, it is provided by Resolution No. 2441 of the City Council of the City of San Rafael that surplus in the improvement fund for said Marin Bay Improvement District No. 1 be refunded pro rata to the parties assessed in accordance with Section 10427 of the Streets and Highways Code of the State of California; and WHEREAS, installments have been paid upon the assessments by the parties assessed; and WHEREAS, there is presently in the improvement fund for z08 MARIN BAY IMPROVEMENT DISTRICT NO. 1 a surplus of fi ql_ ✓ ORIGINAL Deputy NOW, THEREFOREO BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN RAFAEL, STATE OF CALIFORNIA, as follows: 1. The City Treasurer and the City Clerk of the City of San Rafael are authorized and directed upon the adoption of this Resolution to pay or to credit pro rata to the owners of the lands assessed within Marin Bay Improvement District No. 1 as such owners appear from the fast saual i d assesgpent_, role the present surplus in the improvement fund for said district as provided in Resolution No. 2441 of the City Council of the City of San Rafael.
