HomeMy WebLinkAboutCC Resolution 3115RESOLUTION NO. 3115 RESOLUTION FINDING THE PUBLIC INTEREST, CONVENIENCE, AND NECESSITY OF THE ACQUISITION OF PROPERTY FOR STREET AND HIGHWAY PURPOSES AND ORDERING THE CONDEMNATION THEREOF. BE IT RESOLVED by the City Council of the City of San Rafael, Marin County, California, that it finds and determines that the public interest, convenience and necessity require the acquisition; for street and highway purposes, of that certain real property located and situated and being in the City of San Rafael, County of Marin, State of Califor hand more particularly described on Exhibit "A" which is attached hereto and incorporated herein in full. BE IT FURTHER RESOLVED that said real property is necessary for street and highway purposes; that the public interest, convenience and necessity require and it is necessary for said public improvement that the City of San Rafael acquire said real property for said public improvement; that it is necessary for said public improvement that the City of San Rafael acquire said real property in fee simple for said real property is to be applied, and that said action is a public use authorized by law; that said public improvement is planned and located in the manner which will be most compatible for the greatest public good and the least private injury; and BE IT FURTHER RESOLVED that the City Attorney of the City of San Rafael, be and he is hereby authorized to bring eminent domain proceedings for the purpose of acquiring the property hereinabove described; and BE IT FURTHER RESOLVED that the said City Attorney is hereby authorized to take any an all proceedings in eminent domain for the acquisition of said property; and BE IT FURTHER RESOLVED that said Counsel, hereinabove mentioned, be and he is hereby instructed to take -all necessary steps and proceedings to obtain immediate possession of said property pending the final outcome of the eminent comain proceedings hereby authorized. BE IT FURTHER RESOLVED that the City Clerk of the:City of San Rafael shall draw a warrant for the sum of TWENTY THOUSAND SEVEN HUNDRED EIGHTY FOUR MW ($20,784.00) DOLLARS payable to the owners of record, HEIRS AND DEVISEES OF THE ESTATE OF COLUMBUS L. PIERCE, deceased, to be placed in escrow as full payment for said property so as to enable the City of San Rafael to obtain immediate possession of said real property. I, W. L.
