RESOLUTION RESCINDING RESOLUTION NO. 3086 ADOPTED
ON THE 20TH DAY OF JULY, 1964, AND ACCEPTING GRANT
OF REAL PROPERTY FROM KERNER-BELLAM REALTY COMPANY
AND DIRECTING THE RECORDING THEREOF.
WHEREAS, on the 20th day of July, 1964, the City Council
of the City of San Rafael, Marin County, California, adopted
Resolution No. 3086 accepting a deed from the KERNER-BELLAM REALTY
COMPANY, a California corporation, to the CITY OF SAN RAFAEL and
directing said conveyance to be duly recorded in the office of
the County Recorder; and
WHEREAS, subsequent thereto it was determined that certain
properties described in said deed should not be_granted to the CITY
OF SAN RAFAEL at this time; and
WHEREAS, said deed has not been recorded;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of San Rafael, Marin County, California, as follows, to wit:
1. That Resolution No. 3086 adopted by said City Council
on July 20, 1964, is hereby rescinded and the deed accepted pursuant
thereto is hereby declared to be null and void.
2. That that certain grant of real property for pump site,
easements and rights-of-way for drainage channel, force main, streets
and public utilities, executed by KERNER-BELLAM REALTY COMPANY, a
California corporation, to the CITY OF SAN RAFAEL, dated July 20,
1964, be, and the same is hereby accepted and the Clerk of said City
is hereby directed to cause said conveyance to be duly recorded in
the office of the County Recorder of the County of Marin, State of
California, forthwith upon the adoption of this resolution.
I HEREBY CERTIFY that the foregoing resolution was duly and
regularly introduced and adopted'at a regular meeting of the Council
of the City of San Rafael, California, held on Monday, October 5, 1964,
by the following vote, to wit:
AYES: Councilmen Aby, Baar, Barbier, Jensen, and Mayor McInnis
NOES: Councilmen
ABSENT: Councilmen
