HomeMy WebLinkAboutCC Resolution 3211RESOLUTION NO. 3e-211 A RESOLUTION OF INTENTION TO VACATE PUBLIC UTILITY EASEMENT IN SAN RAFAEL CAYES, UNIT ONE RESOLVED, by the City Council of the City of San Rafael, California, and this Council does hereby FIND, ORDER AND DETERMINE, that 1. This Resolution is adopted pursuant to the Public Service Easements Vacation Law, Sections 50430 and following of the Govern- ment Code. 2. The public interest and convenience require and it is the intention of this Council to vacate an easement for drainage purposes in San Rafael Cayes, Unit One, in the City of San Rafael, State of California, more particularly described as follows: Beginning at the northeasterly corner of Lot 13, as said lot is shown and delineated upon that certain map entitled "Map of San Rafael Cayes, Unit One, San Rafael, California", recorded December 23, 1963, in Book 12 of Maps at Page 55, Marin County Records; thence along the easterly boundary of said lot South 20028' West, 354.76 feet; thence South 690321 East, 10.00 feet to the true point of beginning; thence con- tinuing South 690321 East, 20.00 feet; thence South 20028, West, 116.29 feet; thence on the arc of a curve to the left, the center of which bears South 40035120" West, having a radius of 200.00 feet, a central angle of 6008132", a dis- tance of 21.44 feet; thence North 20028'East, 108.59 feet to the true point of beginning. Reference is hereby made to a map entitled "San Rafael Cayes, Unit One", which map is on file in the office of the City Clerk of the City of San Rafael, and recorded in Volume 12 of Maps at page 55, Marin County Records. 3. Notice is hereby given that Monday, the day of April, 1965, at 8:00 o'clock P.M., in the Council Chambers, City Hall, San Rafael, California, are hereby fixed as the time and place when and where all persons interested in, or having objec- tions to, the proposed vacation of said easement may appear before said Council and be heard. 4. The City Clerk of this City shall publish notice of the time and place fixed for said hearing and of the adoption of this U��iUltea� resolution once in the San Rafael Independent Journal, a newspaper of general circulation published within the City of San Rafael, for two successive weeks prior to the hearing. 5. Notices of the vacation of said easement shall be posted conspicuously along the line of said easement, or part thereof, proposed to be vacated at least ten (10) days before the date set for the hearing. Such notices shall be posted not more than 300 feet apart, but at least three (3) shall be posted, along the line of said easement.
