Deputy City Attorney 11 Lisa Goldfien announced that no reportable action was taken ORAL COMMUNICATIONS OF AN URGENCY NATURE - 8:00 PM Brown Act/Albert Park/Target: - File 9-1 Barry Taranto expressed appreciation to Gus Bush, Information Technology Manager, for his work on implementing video -streaming of City Council meetings. Mr. Taranto suggested utilizing speaker cards for public comment at City Council meetings. He encouraged bringing professional baseball to Albert Park and commented "Target will come back to bite you." Big Boxing of Marin: - File 9-1 Clayton Smith addressed the economic effects of large business entities taking over a segment of retail in the United States. Target: - File 9-1 Bill Callahan stated he believed big box stores were unhealthy for people, communities and the planet because of their business model. Craig Slater and Bill Daniels Bill Daniels, United Market, stated that while he was disappointed about the vote on Target last week he was not discouraged; however, he believed "Keep it Local San Rafael' was not afforded an opportunity to register a complaint. Craig Slater distributed a financial summary of Target, noting Target receives approximately 15% of their yearly profit from their credit card business, and he challenged the AECOM Community Impact Report for lack of breadth and depth. Brad Flaherty questioned whether San Rafael had been targeted as an economic downturn area that such stores as Target or Wal Mart could exploit CONSENT CALENDAR: 3. Ritter Center Presentation Regarding Homelessness and Housing First Program (RA) - File 13-16 x R-392 Stephanie Lovette explained that Affordable Housing Week works with communities and lets them into affordable housing units. Tonight's focus would be on the impact of homelessness and the lack of affordable housing. Dianne Linn, Director Ritter Center, gave a PowerPoint presentation on Homelessness and the Housing First Program. Councilmember comments and questions: Councilmember Heller Councilmember Heller inquired as to the location of the one -room apartments. Councilmember Levine Councilmember Levine inquired as to how data could be obtained on the precariously housed. Councilmember Connolly Councilmember Connolly invited Ms. Linn to comment on the rotating homeless shelter program. Councilmember Brockbank Councilmember Brockbank requested clarification on the requirement to keep locations secret. Councilmember Brockbank Having housed some of the homeless Councilmember Brockbank inquired whether statistics could be visited annually to demonstrate the progress. Mayor Boro Mayor Boro stated it was important that success be tracked and reported. He clarified that the program was spread throughout Marin County. Councilmember Heller Councilmember Heller expressed pleasure that San Rafael was not alone in this venture. 10. ABAG's Sustainable Communities Strategy Initial Vision Scenario (CD) - File 111 Sustainable Communities Strategy Linda Jackson Linda Jackson, Principal Planner, presented the staff report. Councilmember comments and questions Mayor Boro Mayor Boro commented that the alternative was for San Rafael to have 3,287 units instead of 5,045. Councilmember Brockbank Councilmember Brockbank inquired as to how accurate the projections were likely to be. Linda Jackson Councilmember Brockbank Linda Jackson Nancy Mackle, City Manager Ms. Mackle stated that together with physical constraints the state was poised to potentially shut down Redevelopment Agencies, including some of their housing funding sources. Councilmember Levine Councilmember Levine inquired as to what could be done when faced with these unforseeable obligations. Linda Jackson Councilmember Connolly Councilmember Connolly inquired as to Option 3. Nancy Mackle Suggesting a question be included to ABAG on how to opt out of the PDAs, Councilmember Heller noted that a workshop was scheduled for May 11, 2011 - 5:30 - 8:30 p.m. at the Embassy Suites Hotel, San Rafael. Mayor Boro Mayor Boro clarified that submitting Option 1 was a step along the way. Mayor Boro Councilmember Levine Councilmember Levine inquired as to a formula for number of units to transportation dollars, etc. Councilmember Brockbank moved and Councilmember Heller seconded - Approve staff recommendation - Option 1 - AYES: Councilmembers: Brockbank, Connolly, Heller, Levine & Mayor Boro NOES: None ABSENT: None OTHER AGENDA ITEMS: 11. Formation of the Pt. San Pedro Road Median Landscaping Assessment District (PW) - File 6-56 1) Resolution Approving and Authorizing the City Manager to Execute a Memorandum of Understanding Between the City of San Rafael and the County of Marin Concerning the Formation of the Pt. San Pedro Road Median Landscaping Assessment District and Rescinding Former Resolution No. 13128 Councilmember Connolly moved and Councilmember Levine seconded to adopt the Resolution AYES: Councilmembers: Brockbank, Connolly, Heller, Levine & Mayor Boro NOES: None ABSENT: None RESOLUTION NO. 13149 — RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SAN RAFAEL AND THE COUNTY OF MARIN CONCERNING FORMATION OF THE PT. SAN PEDRO ROAD MEDIAN LANDSCAPING ASSESSMENT DISTRICT, AND RESCINDING FORMER RESOLUTION NO. 13128 2) Resolution of the City Council of the City of San Rafael Declaring its Intention to Order Formation of the Pt. San Pedro Road Median Landscaping Assessment District, to Levy and Collect Assessments, and to Issue Bonds; and for Such Purpose Setting a Public Hearing and Directing the Mailing of a Notice of the Public Hearing and Ballot on Formation of the District to Affected Property Owners Councilmember Heller moved and Councilmember Levine seconded to adopt the Resolution AYES: Councilmembers: Brockbank, Connolly, Heller, Levine & Mayor Boro NOES: None ABSENT: None RESOLUTION NO. 13150 — RESOLUTION DECLARING ITS INTENTION TO ORDER FORMATION OF THE PT. SAN PEDRO ROAD MEDIAN LANDSCAPING ASSESSMENT DISTRICT, TO LEVY AND COLLECT ASSESSMENTS, AND TO ISSUE BONDS; AND FOR SUCH PURPOSE SETTING A PUBLIC HEARING, AND DIRECTING THE MAILING OF A NOTICE OF THE PUBLIC HEARING AND BALLOT ON FORMATION OF THE DISTRICT TO AFFECTED PROPERTY OWNERS Pt. San Pedro Median Assessment Dist Nader Mansourian, Public Works Director Public Works Director Nader Mansourian presented the staff report. Andrew Perry Andrew Perry thanked City staff, Median Committee and supporters of the project, noting almost $70,000 had been raised to get the project to this point. Alan Schavitz Alan Schavitz expressed his support for the project. David Dempsey David Dempsey reported that he had worked on the medians for a long time and believed this was the correct course of action Al Barr Indicating that this would benefit the neighborhood and the entire City, Mr. Barr urged the City Council to vote in favor of the project. Mayor Boro Congratulating Andrew Perry for his hard work, Mayor Boro stated that this was a good example of a public/private partnership. Councilmember Connolly Councilmember Connolly stated this represented a great example of a public/private partnership that could be duplicated in appropriate circumstances. He cautioned that everything legally be done with the ballots to avoid any issues arising. Councilmember Levine Believing this to be an important milestone, Councilmember Levine expressed thanks for the work, noting the City was making very difficult decisions regarding funding priorities. CITY MANAGER'S REPORT: 12. Nancy Mackle Volunteering: - File 9-3-11 City Manager Nancy Mackle stated she wanted to ensure that those volunteering in the community were doing so safely and she noted the City's Volunteer Coordinator would be happy to assist. COUNCILMEMBER REPORTS / REQUESTS FOR FUTURE AGENDA ITEMS: (including AB 1234 Reports on Meetinqs and Conferences Attended at Citv Expense) - File 9-1 13. Councilmember Levine MTA - Councilmember Levine reported that the MTA had moved to switch Comcast to a state franchise. Living Wage Ordinance - With regard to scheduling a study session on a Living Wage Ordinance, he agreed to provide further information to the City Council subsequent to adoption of the budget. Council Discussion: Councilmember Heller Councilmember Connolly Councilmember Brockbank Councilmember Heller Mayor Boro Councilmember Levine Nancy Mackle Venture Greenhouse - Councilmember Connolly reported on a program launched by Dominican University in partnership with a building owner who donated space to seek funding, training, etc. to foster start-up businesses.
