RESOLUTION ORDERING REMOVAL OF POLES AND OVERHEAD
WIRES AND ASSOCIATED OVERHEAD STRUCTURES FROM THAT
PORTION OF PARCEL THREE OF UNDERGROUND UTILITY DIS-
TRICT, ADJACENT TO THIRD STREET EXTENSION, WESTERLY
FROM SHAVER STREET TO SECOND STREET.
WHEREAS, a public hearing was held by the City Council of the City
of San Rafael on the / day of G 1965 to ascertain
whether the public necessity, health or safety requires the removal of poles
and overhead wires and associated overhead structures in that certain "Under-
ground Utility District" hereinafter described; and
WHEREAS, notice of said public hearing was given as required by
law; and
WHEREAS, the Council of the City of San Rafael, State of California,
finds that the public necessity, health and safety require the removal of
poles and overhead wires and associated overhead structures as defined in
Ordinance 780 of the City of San Rafael, State of California, in the "Under-
ground Utility District" hereinafter described;
NOW, THEREFORE, it is resolved as follows:
1. That the public necessity, health and safety require the re-
moval of poles and overhead wires - and associated overhead structures, in-
cluding poles, towers, supports, wires, conductors, guys, stubs, platforms,
crossarms, braces, transformers, insulators, cut-outs, switches, communica-
tion circuits, appliances, attachments and appurtenances located above
ground and used or useful in supplying electric, communication, or similar
or associated service in that certain "Underground Utility District" in the
City of San Rafael, State of California, described as follows:

cribed by County Assessor's Parcel Numbers:

2. That it is hereby ordered that all poles and overhead wires
and associated structures, as defined in Ordinance 780 of the City of San
Rafael, State of California, including the items described above in sub-
paragraph 1 of this Resolution, that are within the above described "Under -
gr and Utility District", be removed on or before the / C�& day of
196, and all property owners which are affected by the
withi order shall be ready to receive underground service on or before said,

3. Within ten (1) days of the passage of this Retoluiioh, the
City Clerk of the City of San Rafael, California, shall notify all affected
utilities and all persons owning real property within the "Underground Utility
District" above described of the adoption of the within Resolution, and shall
further notify said property owners of the necessity that if they, or any
person occupying such property, desire to continue to receive electric, com-
munication or other similar or associated service, they or such occupant -shall
provide all necessary facility changes on their premises so as to receive such
service from the lines of the supplying utility or utilities at a new location,
subject to applicable rules, regulations and tariffs of the respective utility
or utilities on file with the Public Utilities Commission of the State of Cali-
fornia, and to the requirements of the laws of the State of California and of
the City of.San Rafael, California.
4. The Clerk of the City of San Rafael, California, shall give the
notification required above by mailing a copy of the within RESOLUTION ORDERING
REMOVAL OF POLES AND OVERHEAD WIRES AND ASSOCIATED OVERHEAD STRUCTURES FROM'
THAT PORTION OF PARCEL THREE OF UNDERGROUND UTILITY DISTRICT, ADJACENT TO
THIRD STREET EXTENSION, WESTERLY FROM SHAVER STREET TO SECOND STREET, together
with a copy of Ordinance 780 and 824 of the City of San Rafael, California, to
the affected utilities and to the affected property owners as such are shown
on the last equalized tax roll of the County of Marin, State of California.
I, W. CLIFFORD CORNWELL, Clerk of the City of San Rafael, State of
California, hereby certify that the foregoing Resolution was duly and regularly
introduced and adopted at Regular meeting of the Council of said City held
