Home My WebLink AboutCC Resolution 3410RESOLUTION NO. 3410 RESOLUTION ORDERING REMOVAL OF POLES AND OVERHEAD WIRES AND ASSOCIATED OVERHEAD STRUCTURES FROM THAT PORTION OF PARCEL FOUR OF CHARTER ORDINANCE N0. 829 OF THE UNDERGROUND UTILITY DISTRICT, ADJACENT TO THIRD STREET AND SAN PEDRO ROAD FROM UNION STREET TO THE CENTER LINE OF HARBOR VIEW COURT. WHEREAS, a public hearing was held by the City Council of the City of San Rafael on the 18th day of April, 1966 to ascertain whether the public necessity, health or safety requires the removal of poles and overhead wires and associated overhead structures in that certain "Underground Utility District" hereinafter described; and and WHEREAS, notice of said public hearing was given as required by law; WHEREAS, the Council of the City of San Rafael, State of California, finds that the public necessity, health and safety require the removal of poles and overhead wires and associated overhead structures as defined in Ordinance 780 of the City of San Rafael, State of California, in the "Underground Utility District"hereinafter described; NOW, THEREFORE, it is rasolvod as follows: 1. That the public necessity, health and safety require the removal of poles and overhead wires and associated overhead structures, including poles, towers, supports, wires, conductors, guys, stubs, platforms, crossarms, braces, transformers, insulators, cut-outs, switches, communication circuits, appliances, attachments and appurtenances located above ground and used or useful in supply- ing electric, communication, or similar or associated service in that certain "Underground Utility District" in the City of San Rafael, State of California, described as follows: A portion of Parcel 4 as described in Charter Ordinance No. 829 being the entire width of Third Street and San Pedro Road and all properties contigyous thereto more particularly described as follows, beginning at the intersection of the center lines of Third and Union Streets, running thence easterly along the center line of Third Street to its easterly terminus, thence continuing easterly along the center line of San Pedro Road to its intersection with the center line of Harbor View Court, 2. That it is hereby ordered that all poles and overhead wires and associated structures, as defined in Ordinance 780 of the City of San Rafael, State of California, including the items described above in subparagraph 1 of this Resolution, that are within the above described ''Underground Utility District", be removed on or before the 18th day of July, 1966, and alt property owners which are affected by the within order shall be ready to receive under- ground service on or before said date. - nRIGINAI 3. Within ten (10) days of the passage of this Resolution, the City Clerk of the City of San Rafael, California, shall notify al) affected utilities and all persons owning real property within the "Underground Utility District" above described of the adoption of the within Resolution, and shall further notify said property owners of the necessity that if they, or any person occupying such property, desire to continue to receive electric, com- munication or other similar or associated service, they or such occupant shall provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of Cali- fornia, and to the requirements of the laws of the State of California and of the City of San Rafael, California. 4. The Clerk of the City of San Rafael, California, shall give the notifica- tion required above by mailing a copy of the within RESOLUTION ORDERING REMOVAL OF POLES AND OVERHEAD WIRES AND ASSOCIATED OVERHEAD STRUCTURES FROM THAT PORTION OF PARCEL FOUR OF THE UNDERGROUND UTILITY DISTRICT, ADJACENT TO THIRD STREET AND SAN PEDRO ROAD FROM UNION STREET TO THE CENTER LINE OF HARBOR VIEW COURT, together with a copy of Ordinances 780 and 829 of the City of San Rafael, California, to the affected utilities and to the affected property owners as such are shown on the last equalized tax roll of the County of Marin, State of Cal ifo rnia. 5. The provisions of this Resolution shall not apply to an electric distribu- t 6o.-s7stamt as described in Section 11.28.070(c) of the San Rafael Municipal Code. I, W.
