Subject title: Materials Testing for Du Bois CMP Replacement
Task Order Amount: $3,535
THIS TASK ORDER is entered into on Dec 17, 2024 between the City of San Rafael,
a municipal corporation ("City"), and Ninyo & Moore Geotechnical & Environmental Sciences
Consultants, ("Contractor").
RECITALS
A. The City and Contractor (as may be identified as "Consultant" in the original Agreement) have
entered into a Service Level Agreement ("Agreement") dated May 28, 2024 under which
Contractor has agreed to perform certain contract services for the City; and
B. Pursuant to the terms of the Agreement, the City wishes Contractor to perform certain tasks as set
forth in this Task Order, which constitute the Work;
NOW, THEREFORE, City and Contractor agree as follows:
AGREEMENT
1. Scope of services. Contractor shall provide any and all of the services set forth in Exhibit A of
this Task Order, for an amount not to exceed the Task Order Amount, identified above, as directed by the
City.
Lothus Hennefer shall be the Project Manager for Contractor for this Task Order. Additional contract
services may be performed by other Contractor staff with prior notice and approval by City.
a. City's duties. The City will:
(1) Determine the scope of services, as set forth in Exhibit A.
(2) Make available work plans and specifications and other City data related to the project,
including full information as to the City's requirements.
(3) Designate Adeel Shaikh, or their designee as the person at the City responsible for
monitoring performance under this Task Order.
b. Contractor duties. The Contractor will:
(1) Provide and perform tasks identified in Exhibit A, Scope of Services.
(2) Provide miscellaneous services related to the Work and not stipulated elsewhere in this
Task Order, when requested by the City in writing. A Task Order Amendment is
required if these additional services cannot be performed within the Task Order budget.

2. Date of completion: Work hours estimate-. Cost estimate and budget: Fee schedule: Costs are not -
to -exceed stated Task Order Amount in this Task Order. See Exhibit A for Work and fee schedule details.
3. Authorization to proceed.
The City will give Contractor authorization to proceed with the work specified in this Task Order only after
Contractor submits updated insurance certificates and endorsements, in accordance with the Agreement.
4. Service Level Agreement terms: Conflicts.
Except as expressly otherwise provided herein, all terms of the Agreement shall apply to Contractor in the
performance of work pursuant to this Task Order. If there is a conflict between this Task Order and the
Agreement, this Task Order shall control.
5. Amendment of Task Order; Conflicts.
Except as provided in Section 1(b)(2) above, this Task Order may not be modified except by an Amended
Task Order executed and approved in the same manner as the Task Order.
6. Signatures. The parties have executed this Task Order, as of the date first written above.

Ninyo & Moore is pleased to submit this proposal to provide materials testing services for the Du
Bois St. CMP Repair Project in San Rafael, California. This proposal includes our proposed scope
of services and associated cost estimates, which are based on our review of the project documents
and our previous experience with similar projects.
PROJECT UNDERSTANDING
We understand that this project replacing curb, gutter, sidewalk, and catch basin in addition to
repairing corrugated metal pipe (CMP) along Du Bois St. in San Rafael. This project will include
demolition of concrete and asphalt along Du Bois St., compaction of native soil and repaving/placing
concrete and asphalt.
PROPOSED SCOPE OF SERVICES
Based on our review of the project documents, and our experience with similar projects, we propose
to provide the following scope of services:
Materials Testing Services
• Sampling of aggregate base from the job site and transportation to our laboratory for testing.
• Maximum compacted density determinations of aggregate base in the laboratory accordance
with ASTM D-1557.
• In-place field density testing of soils and aggregates using a nuclear density gauge in accordance
with ASTM D-1557 to determine the relative compaction of compacted aggregate base

• Concrete sampling including slump and temperature tests of concrete and cast compressive
strength test specimens (1 set / 150 cubic yards) on site.
• Concrete sample pick-up and transportation to our laboratory for curing and testing.
• Compression testing of concrete cylinders in the laboratory.
Project Management
• Prepare daily field reports documenting observations and field test results, and reports of
laboratory testing to be submitted to the project team.
• Prepare final affidavit letter at the conclusion of the project.
ESTIMATED FEE
We propose to perform the scope of services described above, on a time -and -materials basis in
accordance with the attached Schedule of Fees.
Our fee estimate for the scope of services described for the new construction project is $3,535
(Three Thousand Five Hundred Thirty Five). Our detailed estimate of fee is attached (Table 1).

Special equipment charges will be provided upon request.
Our field services, are charged at a 4 -hour minimum, and 8 -hour minimum for hours exceeding 4 hours. Overtime rates
at 1.5 times the regular rates will be charged for work performed in excess of 8 hours in one day Monday through
Friday and all day on Saturday. Rates at twice the regular rates will be charged for all work in excess of 12 hours in
one day, all day Sunday and on holidays.
Field services that may be subject to prevailing wage in accordance with AB 1768 and Prevailing Wage
Determinations, will be subject to a prevailing wage surcharge as shown in our Schedule of Fees. Our rates will be
adjusted in conjunction with the increase in the Prevailing Wage Determination during the life of the project, as
applicable.
The terms and conditions are included in Ninyo & Moore's Work Authorization and Agreement form.
