HomeMy WebLinkAboutCC Resolution 3473RESOLUTION NO. 3473 A RESOLUTION AUTHORIZING THE SIGNING OF A QUIT- CLAIM DEED THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES, that the slope easement in the Quitclaim Deed, a copy of which is here- by attached and by this reference made a part hereof, is hereby extinguished, and the Mayor and City Clerk are authorized to execute, on behalf of the City of San Rafael, said deed. , W. CLIFFORD CORNWELL, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City held on Monday the lst day of August, 1966, by the following vote, to -wit: AYES: Councilmen: Aby, Baar, Barbier, Jensen and Mayor Bettini NOES: Councilmen: None ABSENT: Councilmen: None W. CLfFFORD CORNWELL City/Clerk hl6 1NA1 - '_ pjUITCLAIM OF EASEMENT WHEREAS, on the 20th day of September 1956 and on the 16th day of December 1959, BERNARD T. HOFFMAN executed Grant Deeds to the State of California, such Grant Deeds being recorded on November 9, 1956 and January 26, 1960, respectively, in Marin County Official Records at Liber 1072,page 214, and Liber 1340 at page 249; and WHEREAS, under the terms of the respective grants to the State of California, certain slope easements were conveyed to the State of California over portions of the real property owned by Hoffman; and WHEREAS, on the 16th day of April, 1962, all rights of the State of California under the above described deeds from Koffman were relinquished to the City of San Rafael, including the rights to the above referred to slope easements; and WHEREAS, all rights of BERNARD T. HOFFMAN in the real property described in the two deeds was conveyed to CARLOS E. GONZALEZ and MICHELLE GONZALEZ, his wife, CHARLES BELL and MARGARET J. BELL, his wife, and SIDNEY BRAVERMAN and EDNA M. BRAVERMAN, his wife; and WHEREAS, prior to the first day of August 1966, the said persons as owners of the real property desired to be quitclaimed did cause substantial excavation to be performed on the real prop- erty and did remove the slopes within the area hereinafter des- cribed and did thus extinguish the slope easements and the necessity for continued maintenance thereof, and the City Engineer has certif- ied that the land hereinafter described -no longer contains any slopes and thus, the slope easements have been extinguished; and WHEREAS, the City Council of the City of San Rafael did on the 11Si day of August 1966 pass a resolution wherein it was resolved that the slop: easements had been extinguished and a quitclaim deed should be executed by the City of Saiz Rafael., quit- claiming all right, title and interest of the City of San Rafael in the real property hereinafter described in order that the official records of Marin County would correctly reflect that the easement has been extinguished, NOW THEREFORE, The City of San Rafael does hereby acknowledge that the slope easement previously created was extinguished prior to the first day of August 1966 by reason of the fact that all slopes within the real property hereinafter described were removed, and the City of San Rafael by this instrument, does hereby remise, release and forever quitclaim to CARLOS E. GONZALEZ and !MICHELLE GONZALEZ, his wife, CHARLES BELL and MARGARET J. BELL, his wife, and EDNA M. BRAVERMAN, individually and as executrix of the Estate of SIDNEY BRAVERMAN, deceased, the following described rea? property in the State of California, County of Marin, City of San Rafael: All that certain portion of Lot 1, as shown upon the map entitled, "Map of Marin Center Unit 1, in the City of San Rafael, California", filed in the office of the County Recorder of the County of Marin on June 30, 1966 in Map Book. 13 at page 76, described as follows: Beginning at the Southwestern corner of said Lot 1; thence along the Southern lane of said Lot, North 89051100A1 East 49,58 feet to the most Southern corner of Parcel Two, as described in the Deed to the State of California, recorded January 26, 1960 in Book 1340 of Official Records at page 247; thence along the Northeastern line of said Parcel Two (1340/247) North 360 42145" West 268.47 feet; thence leaving said Northeastern line South 27015' 00" East 242.23 feet to the point of beginning.
