RESOLUTION
URGING INSURANCE COVERAGE
BE EXPANDED TO INCLUDE SLIDE DAMAGES
WHEREAS, insurance companies have in recent years precluded land
slide insurance coverage in their insurance contracts; and
WHEREAS, although most cities and counties, by enforcement of their
Building Codes and local Ordinances, make a determined
effort to protect the home buyer by requiring investigation
of suspected subterranean soil conditions, it is found to
be impossible to predict all unknown soil conditions; and
WHEREAS, many persons purchase their homes by utilizing their total
life savings, plus obligating themselves for additional
large sums, and are denied the privilege of protecting such
savings; and
WHEREAS, insurance companies, in the public interest, should provide
land slide insurance since they have, through the 'Law of
Numbers', the only realistic means of distributing loss; and
WHEREAS, land slides, as the result of rampageous elements, happen
at such infrequent times, but with such devistation; and
WHEREAS, the loss of one's home by slide damage not only results in
financial disaster, but causes extreme mental anguish to be
suffered by those persons involved.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Rafael does urgently request the State of California
to legally enforce the inclusion of such property damage
coverage by all insurance companies writing and issuing
policies within this State.
BE IT FURTHER RESOLVED, that the City Clerk be directed to submit
copies of this Resolution to The League of California Cities,
County Supervisors' Association, County of Marin and all
California cities strongly urging their support of the
necessary legislation to effect this action.
