A RESOLUTION AUTHORIZING TRANSFER OF SURPLUS
FUNDS TO THE MAINTENANCE FUND OF THE
SAN RAFAEL CAYES DRAINAGE MAINTENANCE DISTRICT
SAN RAFAEL CAYES
RESOLVED, by the City Council of the City of San Rafael,
California, that
WHEREAS, said Council, pursuant to Resolution of Intention
No. 3204, adopted March 15, 1965, provided for the acquisition and
construction of certain public improvements and for the levy of
assessments to pay the costs thereof, all as therein particularly
described;
WHEREAS, upon completion of said project and the payment of
all costs of construction and acquisition and of all incidental
expenses in connection therewith, a balance of $2,10+.65 remains
in the Construction Fund for said project;
WHEREAS, concurrently with the formation of said assessment
district, the Council duly formed the San Rafael Cayes Drainage
Maintenance District, with boundaries co -extensive to those of the
various drainage facilities acquired and constructed in said pro-
ceedings; and
WHEREAS, said Council provided in said Resolution of Intention
that any surplus could be applied, among other things, to the main-
tenance of the improvements.
NOW, THEREFORE, IT IS ORDERED, as follows:
1. That the balance remaining in the Construction Fund for
said project, in the amount of $2,10+.65, is surplus..
2. That said amount is hereby ordered transferred to the
Maintenance Fund of the San Rafael Cayes Drainage Maintenance District
and applied to the cost of maintaining and operating the levee, dike,
lagoon and all appurtenances, acquired and constructed in said
assessment proceedings, including the cost of necessary repairs,
replacements, fuel, power, electric current,, care, supervision and
any and all other items necessary for the proper maintenance and
operation thereof, all as provided in the proceedings for the forma-
tion of said Drainage Maintenance District.ORIGINAL
I hereby certify that the foregoing is a full, true and
correct copy of a resolution duly passed and adapted by the City
Council of the City of San Rafael, California, at a meeting
thereof held on the day of 19 by
