HomeMy WebLinkAboutCC Resolution 3682RESOLUTION NO. 3682 RESOLUTION APPROVING ANNEXATION TO THE CITY OF SAN RAFAEL OF UNINHABITED TERRITORY LYING ADJACENT THERETO DESIGNATED AS "SUMMIT AVENUE ANNEXATION" WHEREAS, there has been filed with the City Council as the legislative body of the City of San Rafael, a municipal corporation, a written Petition containing a description of the uninhabited terri- tory described on Exhibit "A" which is attached hereto and incorporated herein by reference, which territory is contiguous to land lying within the boundary of said City, requesting therein that said territory be included in such municipal corporation; and WHEREAS, it appears that it will be to the advantage, bene- fit and best interest of said City to annex said territory to said municipal corporation; and WHEREAS, said annexation proceedings are being taken under the provisions of "Annexation of Uninhabited Territory Act of 1939"; and WHEREAS, said Petition has been signed by or written consent has been filed by the owners of all of the land in the territory pro- posed to be annexed and they have all given their written consent that the property within the territory proposed to be annexed shall be taxed to pay any indebtedness or liability of the City of San Rafael don- tracted prior to or existing at the time of annexation; and WHEREAS, an application for the above described annexation has heretofore been filed with the "Local Agency Formation Commission" which application is and was signed by all of the owners of land within the territory proposed to be annexed; and WHEREAS, the "Local Agency Formation Commission" did, on the 11th day of July, 1968, approve the annexation of said uninhabited territory to the City of San Rafael and pursuant to Section 54797.1 of the Government Code of the State of California, the said "Local Agency Formation Commission" approved and authorized the Council of the City of San Rafael to annex said territory without notice and hearing by the said Council; and -'- 0RJ9-N,4 WHEREAS, no protest has been made against the above described annexation; and WHEREAS, the said City Council approves the annexation of the territory described on Exhibit "A" to the City of San Rafael and elects to proceed with said annexation. NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS: 1. The said City Council hereby approves the annexation of the territory described on Exhibit "A" to the City of San Rafael, and said territory is hereby annexed to the City of San Rafael. 2. That the territory herein annexed is all that certain real property situated in the County of Marin, State of California, described on Exhibit "A" which territory is hereby designated as "Summit Avenue Annexation". 3. The said territory is hereby subjected to taxation after annexation equally with property within the City of San Rafael, to pay any and all indebtedness or liability of the said City contracted prior to or existing at the time of annexation. 4. The Clerk of the City of San Rafael shall immediately pre- pare under the seal of the City of San Rafael, a certified copy of this Resolution, giving the date of its passage, and transmit it to the Secretary of State of California. V1J1 1' V11L VV111\-I-LL.{J Clerk of the City of S 4 Rafael -2- 0 EX'H I B I T "A^" SUMMIT AVENUE ANNEXATION - 1968 DESCRIPTION: Beginning at a point on the City Limits line of the City of San Rafael, which point is the intersection of lines north 21°54' east 181.90 feet and north 9° 34' west 147130 feet, said lines being center lines of Deer Park Avenue; thence from said point of beginning alting said City Limits line north 9°34' west 50.3 feet; thence leaving City Limits line north 78°12' east 61.8 feet, more or less, to a point on the easterly right-of-way of Summit Avenue, which point is the intersection of courses north 110 48' west 210.59 feet and the curve of radius 420 feet, central angle of 15° 101, length of 111.17 feet; thence north 63° 40' east 161.34 feet; thence south 56° 34' east 200.23'feet; thence north 68° 06' east 220 feet; thence south 2° 33' west 124.43 feet; thence south 34° 50' west 345.39 feet to the easterly right-of-way. of Summit Avenue; thence crossing Summit Avenue south 34° 50' west 50 feet; thence along the westerly right-of-way of Summit Avenue along a curve tangent to a line bearing north 55° 10' west havingradius of a 330 feet, through a central angle of 13° 33', a distance of 74.8 feet; thence leaving Summit Avenue south 57° 49' west 228.53 feet to the easterly right-of-way of Deer Park Avenue; thence north 88° 19' west 20 feet to the center line of Deer Park Avenue, said line being the existing limits line of the City of San Rafael; thence along said center line and City Limits line north 10 41' east 43.72 feet, north 33° 07' west 248.2 met, and north 21° 54' east 181.90 feet to the point of beginning.
