RESOLUTION NO. 3719
"RESOLUTION PURSUANT TO CHARTER ORDINANCE NO. 108
FINDING AND DETERMINING THAT CERTAIN DILAPIDATED
BUILDING OR STRUCTURE AT 1623 FIFTH AVENUE IS A
PUBLIC NUISANCE AND DIRECTING THE OWNER TO ABATE
SAME BY RECONSTRUCTION, RAZING OR REMOVAL WITHIN
THIRTY (30) DAYS FROM THIS DATE"
WHEREAS, THE City Council of the City of San Rafael, pursuant to
Charter Ordinance No. 108, has heretofore heard testimony and received evidence
and thereupon finds and determines as follows:
1. That the Building Inspector of the said City of San Rafael has
heretofore in the manner and form and for the time prescribed by Charter Ordinance
No. 108 of said City of San Rafael, given the proper notice entitled "Notice to Abate
Nuisance" by posting the same upon the property hereinafter identified, which notice
was in the form provided in said Ordinance and was posted on said property on the
18th day of October, 1968, and by sending another copy by registered mail (postage
prepaid) addressed to the person who is named as.the owner of said building or
structure on the books of the City Assessor of the City of San Rafael, as kept by
the Marin County Assessor, to -wit; WELLS FARGO BANK, TRUSTEE FOR WILLIAM T. AND
MARGARITE DIMAND, which said notice was mailed on October 18, 1968, and which said
notice notified the owners of the dilapidated building or structure, hereinafter
identified, to appear before this City Council at its meeting November 4, 1968
at the Council Chambers in the City Hall in the City of San Rafael at the hour
of 8:00 o'clock P. M. or as soon thereafter as they could be heard, and to show cause,
if any they had, why said building or structure should not be condemned as a public
nuisance and said nuisance be abated by reconstructing or properly repairing said
building or structure, including concrete foundation, or by removing the same;
2. The dilapidated building or structure, including concrete
foundation, situated at 1623 Fifth Avenue, in the said City of San Rafael , is
by reason of weakened joints, walls, floors and roofs, and fractured and insecure
concrete foundation and wall, so dilapidated and deteriorated as to particularly

endanger the health, safety and welfare of persons and property adjacent to and/or
nearby said dilapidated buildings or structures, and to generally endanger the
health, safety and welfare of any person or persons who may be therein or nearby,
and is a breeding place for rodents and a likely resort for vagrant or dissolute
pe rs ons ;
NOW, THEREFORE, BE IT RESOLVED THAT the aforesaid dilapidated building
or structure, including concrete foundation do constitute a menace to public health,
safety and welfare and it is hereby declared to be a public nuisance.
BE IT FURTHER RESOLVED that the owner of said dilapidated building or
structure, including concrete foundations, be and they are hereby directed to abate
said nuisance, within thirty (30) days from the passage of this resolution by having
the same reconstructed, razed or removed, and said owners are hereby notified that -
if said nuisance is not so abated, said building or structure, including concrete
foundation, will be razed or removed by the Building Inspector and the expense
thereof made a lien on the said lot or parcel of land.
I, W. C. CORNWELL, Clerk of the City of San Rafael, hereby certify that
the foregoing resolution was duly and regularly introduced and adopted at a
$egular meeting of the Council of said City held on Monday the 16th
day of December 1968 9 by the following vote, to -wit,
AYES: COUNCILMEN: Baar, Barbier, Jensen, Miskimen and Mayor Bettini
