RESOLUTION ORDERING VACATION
OF PARTS OF PUBLIC STREETS
WHEREAS, the City Council of the City of San
Rafael, on the 16th day of December 196 8 ,
passed and adopted Resolution No. 3721 entitled
"RESOLUTION OF INTENTION TO ORDER VACATION OF PARTS OF
PUBLIC STREETS", and
WHEREAS, notice was published and posted as
required by law, and
WHEREAS, a hearing was had this day as required
by law, and said Resolution No. 3721 , at which
hearing the Council of the City of San Rafael heard
evidence offered by all persons interested in or objecting
to the vacation hereinafter ordered, and
WHEREAS, it appears from the evidence offered
and from all of the evidence submitted, and the said Council
finds, that the parts of the streets herein described are
unnecessary for present or prospective public street pur-
poses.
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED
that the parts of the public streets, to -wit: McCoy Road
and Bret Harte Road, located in the City of San Rafael,
California, which parts of said streets are hereinafter
more particularly described, are unnecessary for present
or prospective public street purposes and are hereby vacated.
The parts of the public streets proposed to be
vacated are located in the City of San Rafael, State of

California, and are part of McCoy Road, and part of Bret
Harte Road, and are more particularly described as follows:
BEGINNING at a point in the Southeasterly
line of McCoy Road said point being distant
N 580 30' E 58 feet and N 440 E 69 feet
from the Northeast corner of the lot des-
cribed in the deed from Mary Courtright
to Frances Hamilton recorded March 2, 1926
in Liber 90 of Official Records at Page
376, thence along said Southeasterly line
of McCoy Road N 440 E 25 feet, N 85° 48'
E 95.7 feet and N 10° 05' E 111.6 feet to
the Western line of the lots of Julie
Sommer, as recorded in Liber 92 of Deeds
at Page 149, thence along said line N 47°
20' W 48.85 feet to the Northeasterly line
of McCoy Road, thence along the line of
McCoy Road S 100 05' W 105.5 feet, S 850
48' W 81.05 feet, S 440 W 39.846 feet,
thence leaving the Northeasterly line of
McCoy Road S 460 E 42.476 feet to the
point of beginning.
BEGINNING at the intersection of the
northwesterly line of Bret Harte Road
as defined by that certain Map of La
Loma Heights recorded in the office of
the County Recorder, County of Marin in
Book 7 of Maps at page 131, and the south-
westerly line of said La Loma Heights Sub-
division, and running thence southwesterly
along the southwesterly extension of said
northwesterly road line to its intersec-
tion with the westerly line of said Bret
Harte Road as shown on that certain map
entitled "Picnic Valley Tract", recorded
in Book 1 of Maps at page 26; thence
northerly along said westerly line to
the southwest line of La Loma Heights
aforesaid; thence southeasterly along the
said southwest line of La Loma Heights
to the point of beginning.
RESERVED, HOWEVER, to all public utilities
the right to maintain, repair, construct
or reconstruct sewers, water pipes
gas pipes, power lines and
other public utility facilities now in
place in said street, road or alley and
the right of all necessary entry therefor.

I, W.C. CORNWELL, Clerk of the City of San Rafael,
hereby certify that the foregoing Resolution was duly and
regularly introduced and adopted at a regular meeting of the
Council of the City of San Rafael, held on the 6th day
of January 196 9 by the following vote,
