RESOLUTION OF PRELIMINARY DETERMINATION TO UNDERTAKE SPECIAL ASSESSMENT PROCEEDINGS AND SET'l'ING TIME AND PLACE OF HEARING THEREON, EAST SAN RAFAEL DRAINAGE ASSESSMENT DISTRICT NO. 1, CITY OF SAN RAFA.EL, MARIN COUNTY, CALIFORNIA

WHEREAS, the City Council of the City of San Rafael; Marin
County, California, has adopted a map showing the boundaries of pro
posed East San Rafael Drainage Assessment District No. 1, City of San
Rafael, Marin County, California, which said map is entitled "Pro-
posed Boundaries of East San Rafael Drainage Assessment District No. 1,
City of San Rafael, Marin County, California;"
NO\•J, THEREFORE, BE IT RESOLVED by the City Council of the
City of San· Rafael, Marin County, California, as follows:
1.The City Council proposes to implement special assessment
proceedings under the provisions of the Municipal Improvement Act of
1913, with bonds to be issued under the provisions of the Improvement
Bond Act of 1915 of the State of California, for the purpose of con
structing a major drainage system and the acquisition of properties
necessary.for the construction of said system, including the acquisition
. . of properties and the construction of a major street improvement, in-
cluding underground utilities.
2.Monday, the 18th day of January, 1971, at the hour of
8:30 o'clock P.M. of said day, in the Council Chamber of the City of
San Rafael, 1400 -5th Avenue, San Rafael, California, is hereby fixed
as the time and place for·a public hearing when and where any and all
persons interested may appear and show cause, if any they have, why the
City Council of the City of San Rafael should not find and determine
that the public(convenience and necessity require the proposed improve-
ments and acquisitions hereinabove described, without compliance with
the Special Assessment I_nvestigation, Limitation and Majority Protest
Act of 1931.
3.The time and place of hearing shall be given in accord
ance with the provisions of Ordinance No. 590 of the City Council of
the City of San Rafael.

4.The district which shall bear the cost and expenses of
said improvements and acquisitions, including all incidental expenses,
and which·is to be assessed to pay for the costs thereof, is that
district shown on a map whi�h is on file in the office of the City
Clerk of the City of San Rafael, and designated "Proposed Boundaries
of East San Rafael Drainage Assessment District No. 1, City of San
Rafael, Marin County, California."
5.Said district shall be known and designated as "East San
Rafael Drainage Assessment District No. 1, City of San Rafael, Marin
County, California."

I HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted by the City Council of the City of San Rafael, Marin County, California, at a regular meeting thereof, held on the 21st day of December, 1970, by the following vote, to wit:
