HomeMy WebLinkAboutCC Resolution 3989RESOLUTION NO. 3989 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF SAN RAFAEL OF UNINHABITED TERRITORY DES­CRIBED HEREIN AND DESIGNATED 11 SAN..£.EDRO SCHOOiANNEXATION'', AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTEST THERETO WHEREAS, pursuant to the p rovisions of the annexation of Uninhabited Territory Act of 1939 a petition signed by· owners of not less than one fourth of the land by area and by assessed value, as shown on the last equalized assessment roll of the County of Marin, in the hereinafter described territory was filed with the City Council of the City of San Rafael on the 29th day of December 1970 , requesting annexation of the hereinafter described territory to said City; and WHEREAS, pursuant to Sections 35305 and 35306 of the Govern­ ment Code of the State of California the City Council shall, without delay, under the aforesaid circumstances, pass a resolution giving notice of the proposed annexation, describing the boundaries of the terri tory, designat­ ing it by an appropriate name and setting a time and place wherein the City Council will hear written protests against the annexation made by persons owning real property within the territory; and WHEREAS, the matter of the proposed annexation to the City of San Rafael of said territory has been referred to the Local Agency For­ mation Commission for its consideration and approval, and said Local Agency Formation Commission approved the annexation of said uninhabited territory to the City of San Rafael prior to the circulation or filing of the peti­ tion hereinabove referred to; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Rafael, as fol lows: l . That Tues day the 16th of February , 1971, at the hour of 8:00 p.m. in the Council Chambers in the City Hall in the City of San Rafael, California, being a date at least forty (40) and not more than sixty (60) days after the date of passage of the resolution, is hereby fixed as the time and place, when and where the. City Council of the City of San Rafael, California, will hear written protests against said annexation by any person owning real property within said territory -1 -• 1• ...... .J \\\a I n\� Al . . . . ... V' and NOTICE of the time and place of said hearing is hereby given. 2.The City Clerk shall cause a copy of the within Resolu­ tion to be published at least twice but not more often than once a week, in the Independent Journal, a newspaper of general circulation published in the City of San Rafael .and also in a newspaper of general circulation published outside of the City of San Rafael _but in the County of Marin, State of Cali­ fornia, which publication shall be completed at least twenty (20) days prior to the date set forth above for the above described hearing. 3.The City Clerk shall also cause written notice of the above proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized Marin County Assessment Roll available on the date that these proceeding s were initiated, at the address shown on said Assessment Roll or as known to said Clerk, and to any person who has filed his name and address and the designa­ tion of the lands in which he has any interest, either legal or equitable, with said Clerk. Said notice shall be given not less than twenty (20) days before the first public hearing on the proposed annexation. 4.That for appropriate name of said territory so proposed to be annexed to the City of San Rafael, the same is hereby designated as SANJEDRO SCHOOL ANNEXATIONand the boundaries of said territory so pro- posed to be annexed are specifically described on Exhibit 1 1A11 which is attached hereto and incorporated herein in full by reference. I, MARION A.
