HomeMy WebLinkAboutCC Resolution 4046RESOLUTION NO. --/ 0 T4 CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIRES THE FORMATION OF UNDERGROUND UTILITY DISTRICT NO. 3 IN THAT PORTION OF UNDERGROUND UTILITY DISTRICT, PARCEL # i AS DESCRIBED IN ORDINANCE 780, SECTION 1. BE IT RESOLVED by the Council of the City of San Rafael as follows: WHEREAS, Ordinance No. 905 establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in any such district; and WHEREAS, it has been recommended that such an underground utility district, hereinafter called District, be formed on all those properties contiguous to Mission Avenue, Fifth Avenue, Fourth Street, Third Street, 'A' Street, 'B' Street, 'C' Street, 'D' Street and 'E' Street more particularly described in the 1970 Marin County Assessor's Map Book, the following parcel numbers: 11-204-01 11-205-14 11-253-06 11-204-04 11-205-16 11-253-07 11-204-05 11-205-17 11-253-08 11-204-06 11-212-06 11-253-10 11-204-07 11-212-07 11-253-11 11-204-14 11-212-08 11-255-03 11-204-15 11-212-11 11-255-13 11-204-16 11-212-14 11-255-14 11-204-18 11-215-01 11-255-18 11-204-19 11-215-02 11-255-19 11-205-01 11-215-03 11-255-20 11-205-04 11-251-04 11-255-26 11-205-05 11-251-05 11-261-11 11-205-08 11-251-06 11-261-12 11-205-09 11-251-07 11-261-13 11-205-10 11-253-01 11-261-14 11-205-11 11-253-02 11-261-15 11-205-12 11-253-03 11-205-13 11-253-04 ORIGINAL NOW, THEREFORE, be it resolved as follows: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the Council of the City of San Rafael on Jul 6th , 19 71 , at the hour of 8:00 p.m., in the Council Chambers of the City Hall, San Rafael California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the under- ground installation of wires and facilities for supplying electric, comunica- tion, or similar associated service in the District hereinabove described. 2. At such hearing all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 3. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least ten (10) days prior to the date thereof. 4. The area proposed to be included in the District is shown upon that certain map entitled Map of affected Parcels, being a portion of Under- ground Utility District as described in Ordinance No. 780, Section 1, Parcel 1, dated April 16th 1969 , which is on file in the office of the City Clerk of the City of San Rafael Dated: June 7. 1971 I MARION A.
