RESOLUTION APPROVING ANNEXATION TO THE CITY OF SAN
RAFAEL OF UNINHABITED TERRITORY -LYING ADJACENT THERE-
TO DESIGNATED AS "SCETTRINI ANNEXATION". ''
WHEREAS, there has been filed with the City Council as the legis-
lative body of the City of San Rafael, a municipal corporation, a writ-
ten Petition containing a description of the uninhabited territory des-
cribed on Exhibit "A" which is attached hereto and incorporated herein
by reference, which territory is contiguous to land lying within the
boundary of said City, requesting therein that said territory be in-
cluded in such municipal corporation; and
WHEREAS, it appears that it will be to the advantage, benefit and
best interest of said City to annex said territory to said municipal cor-
poration; and
WHEREAS, said annexation proceedings are being taken under the pro-
visions of "Annexation of Uninhabited Territory Act of 1939"; and
WHEREAS, said Petition has been signed by or written consent has
been filed by the owners of all of the land in the territory proposed to
be annexed and they have all given their written consent that the prop-
erty within the territory proposed to be annexed shall be taxed to pay
any indebtedness or liability of the City of San Rafael contracted prior
to or existing at the time of annexation; and
WHEREAS, an application for the above described annexation has
heretofore been filed with the "Local Agency Formation Commission"
which application is and was signed by all of the owners of land within
the territory proposed to be annexed; and
WHEREAS, the "Local Agency Formation Commission" did, on the 9th
day of June, 1971, approve the annexation of said uninhabited territory
of the City of San Rafael and pursuant to Section 54797.1 of the Govern-
ment Code of the Sta to of California, the said "Local Agency Formation
Commission" approved and authorized the Council of the City of San Rafael
to annex said territory without notice without hearing and without election
by the said Council; and
WHEREAS, no protest has been made against the above described annexa-
tion; and
WHEREAS, the said City Council approves the annexation of the terri-
tory described as Exhibit "A" to the City of San Rafael and elects to pro-
ceed with said annexation.
NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS:
1. The said City Council hereby approves the annexation of the terri-
tory described on Exhibit "A" to the City of San Rafael, and
said territory is hereby annexed to the City of San Rafael.
2. That the territory herein annexed is all that certain real property
situated in the County of Marin, State of California, described on Exhibit
"A" which territory is hereby designated as `rScettrini Annexation".
3. The said territory is hereby subjected to taxation after annexation
equally with property within the City of San Rafael, to pay any and all in-
debtedness or liability of the said City contracted prior to or existing at
the time of annexation.
4. The Clerk of the City of San Rafael shall immediately prepare under
the seal of the City of San Rafael, a certified copy of this Resolution,
giving the date of its passage, and transmit it to the Secretary of State
of California.
I, MARION A. GRADY, Clerk of the City of San Rafael, do hereby
certify that the foregoing Resolution was duly and regularly introduced
and adopted at regular meeting of the Council of said City held on
the 6th day of July 1971, by the following vote, to -wit:

COMMENCING at a point on the Northeasterly line of San Pablo Avenue,
said point being the most Southerly corner of the.,parcel conveyed
to Louis Martini et ux, by Deed recorded October 27, 1949 in Book
616 O.R. page 374, and running thence along said Northeasterly line
and the Southeasterly line of said Avenue, South 210 32' East 164.44
feet; thence South 23° 46' West 720.0 feet,more or less, to the
most Northerly corner of the parcel conveyed to James G. Paganetti,
by Deed recorded April 183, 1960 in Book 1360 O.R. page 561, thence
alongg the Northeasterly and Southeasterly lines of said parcel, South
48° 49' East 100.0 feet and South 23° 39' West 90.0 feet to the
Northeasterly line of the parcel conveyed to C. J. Kalberer by Deed
recorded February 11, 1927 in Book 111 O.R. page 285, thence along said
line South 48° 49' East 1403.3 feet to the most Ezsterly corner of
said parcel; said corner being o'n the San Pedro Ridge and being the
Northerly line of the "Coleman Tract'' thence along said ridge North
'55° 42' East 296.2 feet, North 88° 21' East 691.6 feet and North
39° 32' East 219.4 feet to the Southwesterly line of the parcel
conveyed to John Z. Fung, et ux, by Deed recorded June 27, 1947 in
Book 553 O.R. page 237, thence along said line North 470 18' West
181.4Lf feet, more or less, to an angle point in said line that is
common to the courses of "South 37° 22' East 191.05 feet and South
47° 18' East 181.44 feet, more or less ," as set forth in said Deed,
thence still along said line North 37° 22'.West 191.05 feet North
410 54' West 150.82 feet, North 11° 54' West 140.32 feet and North
0° 51' West 176.5 feet to the Southwesterly line of the parcel con-
veyed to John Z. Fung, et ux, by Deed recorded October 30, 1946 in
Book 538 O.R. page 53 thence along said line North 48° 15' West
285.23 feet, North 488 48' West 369.95 feet and North 62° 08' West
1070.0 feet, more or less, to a point that bears North 44° 06' East
from the point of commencement and thence South 440 06' West 204.0
feet, more or less, to the point of commencement.
