RESOLUTION PROVIDING FOR DOING OF PUBLIC WORK (BRET
HARTE SEWER SYSTEM) BY THE CITY COUNCIL OF SAN RAFAEL
WHLREAS, on July 3rd, 1944, the City Council of the City of San Rafael,
�x17_fornia, pursuant to Notice Inviting Sealed Proposals, duly given
..nd published as required by law, did publicly open, examine and dem
,lar -e all sealed bids for doing the following work and improvement in
�,ai.d City, in accordance with the "Specifications for Sewering", "Plan
xad Profile", "Details for the Construction of Sewage Pump House and
.;greening Pit" and "Standard Details", all prepared by J. C. Oglesby,
C. E., all filed in the office of the City Clerk of said City on
J•Lne 12th, 1944, and approved by said City Council on June 12th, 1944,
all providing for the construction and installation of the "Bret Harte
Suver System" in Bret Harte District in said City,
wH1L'R kS, the matter of considering and awarding or accepting bids for
said work was duly and regularly continued to this 19th day of July,
1944,
WHEREAS, Vincent Maggiora was the sole bidder for said work,
WHEREAS, on July 19th, 1944 said City Council, pursuant to Section 3,
Article XIII, of the Charter of said City, did reject all bids for said
work, and all bids therefor are hereby rejected,
WHEREAS, said City Council is of the opinion and does hereby find and
determine that said work maybe more economically done by said City;
NOW THEREFORE, Pursuant to said Article XIII, Section 3, of said Chart-
er, it is hereby ordered, determined and resolved that said work shall
be done and said Sewer System be constructed and installed by said City
by and through the City Council, upon revised plans therefor,
BE IT FURTHER RESOLVED, that the City Engineer and Superintendent of
Streets of said City, as agonts of said City Council be and they are
hereby authorized and directed, subject to the approval of said City
Council, to order and obtain the necessary labor and materials and
equipment therefor, in the open market at the lowest possible prevail-
ing rates and prices, therefor, said materials, labor and equipment
shall be obtained, used, employed and performed under the direction of
said City Council,
BE IT FURTHER RESOLVED, that said work shall commence without un-
necessary delay.
I, Eugene W. Smith, City Clerk of the City of San
Rafael, California, hereby certify that the fore-
going resolution was duly and regularly introduced,
read and adopted by the City Council of said City,
at an adjourned regular meeting thereof held on
Wednesday, the 19th day of July, 1944, by a four-
fifths vote of said Council, to -wit:
