IN THE MATTER OF THE PURCHASE OF
FIRE EQUIPMENT
WHEREAS, the City Council of the City of San
C4pp,,
Rafael, did upon' the day of 0G1 ca"4 1944, determine
that certain equipment was required for fire protection in
the City of San Rafael, and instructed the City Clerk to
make a call for bids thereon, and
tiYHEREAS, Tuesday, the 2nd day of January, 1945,
at the hour of 8:00 o'clock P.M. in the council chambers
of the City Council in the City Hall in the City of San
Rafael, County of Milarin, State of California, were the time
and place fixed for receipt of bids and for the opening and
declaration thereof, and
ffHE.REAS, bids were received from several bidders
and have been publicly opened, examined and declared,
NOW, THEREFORE, the City Council of the City of
San Rafael does hereby find and determine that the bid of
AUERICAN LaFRANCE-FOXfITE COMPANY, offering to construct
and deliver to the City of San Rafael the equipment specified
for the sum of 49,016.00 was and is the lowest bid, and that
said bidder presented and filed the lowest and best bid upon
said equipment within the time provided, and that it is for
the best interest of the City of San Rafael that said bid be
accepted and the equipment specified therein be purchased.
BE IT FURTHER RESOLVED that a contract for the
purchase of equipment from American LaFrance-Foamite Company
be executed on behalf of the City of San Rafael, in the form
set forth in the bid filed, and that the Mayor and City Clerk
of the City of San Rafael ought to be and they are hereby
instructed to execute the same on behalf of the City of San

BE IT FURTHER RESOLVED that the action of the
Mayor and City Clerk and other officers of the City of San
Rafael in executing said contract, following the meeting
of this council, held on January 2, 1945, ought to be and
such actions are ratified and approved.
BE IT FURTHER RESOLVED that the variations be-
tween the filed specifications and the specifications set
forth in the bid are minor and unimportant and that such
variations ought to be and they are waived; that the twelve
cylinder motor specified in the bid is equal to or better
than the six cylinder motor referred to in the filed spec-
ifications, and is in all respects acceptable.
