RESOLUTION REQUESTING THE BOARD OF SUPERVISORS
OF THE COUNTY OF MARIN TO INCLUDE A PORTION OF
FIFTH STREET AS A PART OF THE COUNTY SYSTEM OF
HIGHWAYS.
WHEREAS, Fifth Street in the City of San
Rafael from ".fl Street in said City to the westerly corporate
limits of said City is a public street within said City;
not local;
WHEREAS, the ordinary traffic thereon is
WHEREAS, said street is of more than local
or ordinary use and convenience to the public generally;
WHEREAS, the kind and character of the
real property adjacent thereto and abutting thereon is not
such as to warrant the improvement of said street at the
present time by making the cost thereof a charge upon said
property;
WHEREAS, it appears to this City Council
that said street is in need of improvement or repairs and
that the proper maintenance of said street is of general
county interest and that county aid ought to be extended
therefor,
NOW THEREFORE BE IT RESOLVED that the City
Council of the City of San Rafael do hereby petition the
Board of Supervisors of the County of Marin pursuant to
the authority in said Board of Supervisors vested by law

and by virtue of the provisions of that certain Act of the
Legislature' of the State of California, approved April 30th,
1923, and entitled "An Act Authorizing Counties to Construct,
Improve, Maintain and Repair streets Lying in Municipalities,
etc." to institule and conduct to final completion proceedings
under said Act of the Legislature, as amended, and thereby
determine that the improvement of said street is of general
county interest and declaring said street from '& Street
to the westerly corporate limits of said City to be a part
of the County system of highways and with respect to said
street to exercise the powers granted to said Board of
Supervisors under the provisions of said Act.
