HomeMy WebLinkAboutResolution 628*tz 9/As RESOLUTION AUTHORIZING BID FOR AND PURCHASE I,( OF REAL PROPERTY. WHEREAS, in the opinion of the City Council of the City of San Rafael public interest, necessity and convenience require that a portion of Third Street last of Mary Street in said City be re -aligned and relocated northerly from the existing location thereof; WHEREAS., in order to accomplish said purpose it is necessary to acquire from the Board of Education of the San Rafael High School District a certain strip of land owned by said San Rafael High School District and lying between High Street and Embareadero Way in said City; WHEREAS, it further is necessary in order to accomplish said objects to make said transfers of certain parcels of real property abutting upon Third Street as the same now exist and to acquire from said San Rafael High School District the parcels of real estate hereinafter described so as to enable said City to make the requisite transfers necessary to the consummation of all transfers required in order to accomplish the objects hereof; WHEREAS, heretofore and on the �`3 day of � � 1933, the Board of Education of the City of San Rafael, the governing body of San Rafael High School District did advertise for bids for the sale of those certain parcels of real property situate in the City of San Rafael, County of Marin, State of California, described as follows, to -wit: - 1 - MARTINELLI & GARDINER ATTORNEYS AT LAW ALBERT BUILDING SAN RAFAEL, CALIFORNIA 5 PARCEL ONE: BEGINNING at a point on the northerly line of Third reet distant thereon South 48°081 East 42.00 feet and South 390 151 East 18.88 feet from the southwesterly corner of the land conveyed by the San Rafael Development Company to the San Rafael High School District by deed dated October 23, 1923, and recorded in the Marin County Recorders' Office in Book 29 of Official Records at page 459 thence continuing along the northerly line of Third Street South 390 151 East 87.56 feet; South 470 591 East 56.95 feet; South 55° O11 East 63.21 feet; South 600 261 East 94.58 feet and South 63° 471 East 122.51 feet to a point thereon thence leaving the said northerly line of Third Street North 150 191 East 85.94 feet thence North 660 171 West 397.98 feet to the point of beginning. PARCEL TWO: BEGINNING at a point on the northerly line of Third Street Distant thereon North 781 491 West 118.90 feet and North 871 521 West 51.76 feet from the northwest corner of Third Street and Embareadero Way thence continuing along the said northerly line of Third Street North 870 521 West 66.07 feet and North 880 171 West 73.63 feet to a point thereon, thence leaving the said northerly line of Third Street North 20 411 last 55.60 feet thence South 660 171 East 149.66 feet to the point of beginning. WHEREAS, Said r6al property as a whole is of the fair and reasonableAValue of Two Thousand (22000.00) Dollars, NOW THEREFORE, IT IS HEREBY RESOLVED that subject to the con- ditions hereinafter mentioned said City of San Rafael does,bereby bid the sum of Two Thousand ($2,000.00) Dollars for the purchase of said real property and that the Mayor of said City is hereby authorized to offer the sum of $20000.00 to said Board of Education for the purchase of said real property when and not until said Board of Education shall offer to said City the sum of $2,000.00 for the real property generally known as the San Rafael Development Company 170 foot Canal strip and that portion of existing Third Street fronting on the Board of Education Canal Lot and the San Rafael Development Company 170 feet Canal strip as said parcels have been referred to in the negotiations for the re -alignment of Third Street. BE IT FURTHER RESOLVED that when said respective offers shall have been made and upon the delivery of the respective deeds therefor, a warrant in said sum shall be drawn upon the Treasury, of the City of San Rafael by the appropriate officers and delivered to said Board of MARTINELLI & GARDINER ATTORNEYS AT LAW �j ALBERT BUILDING 2 - SAN RAFAEL, CALIFORNIA Education upon the delivery and acceptance of the deed for the real estate herein first particularly described. BE IT FURTHER RESOLVED that the offer of said Board of Education pursuant to said advertisement calling for bids offering to convey said real property herein first described for said sum of $2,000.00 be and type same is hereby accepted upon the conditions hereinabove contained and that upon the delivery of the deed therefor to said City the same shall be accepted and confirmed pursuant to this resolution and thereupon the Clerk of said City shall endorse his certificate upon said deed certifying to the acceptance thereof and shall thereupon cause the same to be duly recorded in the office of the County Recorder. ----' ----'------ --- (7T—T (!l' l •n �a _ - �'JL�` O: •r r i.,i. cru ?7; r7-, dL ARL.
