RESOLUTION ACCEPTING GRANT OF REAL
PROPERTY.

WHEREAS_, The Board of Education of the City of San Rafael,
the governing body of San Rafael High School District, has made
and executed and offered to deliver to said City a deed granting
and conveying to said City of San Rafael all that certain real
property situate in the City of San Rafael, County of Marin,
State of California, described as follows, to -wit-:+
BEGINNING at a point on the northerly
line of Third Street distant thereon South 481 081 East 33.46 feet from
the Southwesterly corner of the land conveyed by the San Rafael Devel-
opment Company to the San Rafael High School District by deed dated
October 23, 1923, and recorded in the Marin County Reeorderts Office
in Book 29 of Official Records at page 459 thence North 150 341 East
55.31 feet to a point; South 60° 171 East -935.75 feet to the southwesterly
line of Embarcadero Way; thence South 240 501 East 31.94 feet along
the said line of Embarcadero Way to the northerly line of Third Street;
thence following the northerly line of Third Street North 780 491
West 118490 feet and North 870 521 West 51.76 feet to a point therein;
thence leaving the northerly line of Third Street North 6'60 171
West 762.70 feat to a point in the northerly line of Third Street
thence folldwing the northerly line of Third Street North 390 151
West 18.88 feet and North 480 081 West 8.54 feet to the point of
beginning.
WHEREAS, the acquisition of said real property is necessary
for the re -alignment of Third Street east of Mary Street in said
City as more fully appears from the resolution of this .City Council
heretofore adopted,
NOW THEREFORE, IT IS HEREBY RESOLVED AND ORDERED by the City
Council of the City of San Rafael that said offer of dedication and
said deed so delivered and granting to aaid City the real property
herein described be and the same is hereby accepted and confirmed;
that the Clerk of said City shall endorse thereon his certificate
certifying to the acceptance thereof by this resolution and cause the
same to be duly recorded in the office of the County Recorder of the
County of Marin;

BE IT FURTHER RESOLVED that upon the opening of said new portion
of Third Street as re -aligned and upon the completion of any improve-
ment thereon necessary to prepare the same for safe and convenient
traffic by the public that thereupon said City Council shall immediate-
ly commence and prosecute to completion such legal proceedings as
may be necessary in order to close up and abandon all that portion
of Third Street as the .same now exists which may no longer be
necessary or useftl upon opening of said new street, so as to
legally discontinue the rights of the public to the use of the said
for street purposes,
