RESOLUTION AUTHORIZING CONVEYANCE OF
REAL PROPERTY.
WHEREAS, public interest, convenience and necessity
require And it is the intention of the City Council of the
City of San Rafael to re -align, relocate, improve and re -open a
portion of Third Street in said City between High Street and
Embarcadero Way to an alignment northerly from the existing
location thereof;
WHEREAS, in order to accomplish said purposes and to obtain the
necessary strip of land therefor it is necessary to effect various
and sundry transfers of real property between certain owners of
the lands adjacent to said Third Street; and
WHEREAS The Board of Education of San Rafael High School
District have deeded or are about to deed to said City the land
necessary for said re -alignment together with other real property
pursuant to proceedings duly and regularly taken for the sale thereof
and upon the payment of the sum of Two Thousand ($2,000.00) Dollars
by said City in consideration whereof and in order further to
accomplish said purposes said City has agreed to pay said San
Rafael High School District the sum of Two Thousand (2,000.00)
Dollars and to convey to said District the real property herein
described; and
WHEREAS., said City Council is of the opinion and hereby finds
and determines that it is for the best interest of said City to
consummate the negotitations for acquiring said strip of land for
said re -alignment and to convey the real property herein described to
said High School District,

cute on behalf of said City a deed granting and conveying to said
SAN RAFAEL HIGH SCHOOL DISTRICT OF THE COUNTY OF MARIN all those
certain lots, pieces or parcels of land situate in the City of San.
Rafael, County of Marin, State of California, described as follows,

IT IS FURTHER RESOLVED that said Parcel One shall be so conveyed
subject to all existing rights of the public to use the same for

street or other public purposes as provided in all prior dedications
and grants thereof but that said deed shall provide that said City
through its governing body shall upon the completion and acceptance
of the contemplated improvement upon said re -alignment and upon the
opening of said new portion of Third Street to public traffic commence
and institute to completion legal proceedings for that portion of
Third Street as the same now exists which will no longer be required
for street purposes so that upon the completion, acceptance and use of
!aid Third Street as re -aligned Parcel One herein described shall be
abandoned for street purposes.
BE IT FURTEER RESOLVED that said conveyance shall have affixed
thereto the name and seal of said City and it shall be,6elivered
to the Grantee therein upon the payment of said sum of $20000.00
and upon the delivery by said Grantee to the Grantor therein of
the lands necessary to be acquired from said High School District
for the purposes aforementioned.
