qk(31 ORIQ/tv'4A, RESOLUTION OF ACCEP'T'ANCE OF GRANT OF REAL PROPERTY. Wim, The Council of the City of San Rafael proposes and intends and is about to re -align and relocate a portion of Third Street in said City east of Mary Street therein and to open up and throw open to use as a public street a strip of land lying northerly therefrom and to be acquired from the Board of Education of the San Rafael High School District; WHEREAS, in order to accomplish said purposes and to acquire a strip of land necessary or land necessary therefor., it is necessary to acquire from the San Rafael Development Company, a corporation, the real property hereinafter described; SAS, said San Rafael Development Company has offered to grant and convey the real property hereinafter described to the City of San Rafael and deeds therefor have been duly executed and offered for delivery; WHEREAS, said City Council hereby determines that public interest, convenience and necessity require and it it for the best interest of said City that said, Third Street be so re -aligned and opened; NOW THEREFORE, IT IS HEREBY RESOLVED AND ORDERED by the City Council of the City of San Rafael that the offer of said San Rafael Development Company, a corporation, to convey to the City of San Rafael, the MARTINELLI & GARDINER ATTORNEYS AT LAW Y'©alrop ALBERT BUILDING p arty hereafter described nd the delivery of the SAN RAFAEL, CALIFORNIA deed therefor to said City of San Rafael be and the same is hereby accepted and confirmed, subject to all existing uses thereof by the public for street purposes until regularly closed. IT IS FURTHER ORDERED that upon this acceptance of said deed the Clerk of said City shall cause the same to be recorded in the office of the County Recorder of the County of Marin, State of California. The real property hereby accepted is described as follows, to -wit: That certain real property situate in the City of San Rafael, County of Marin, State of California, described as follows: FIRST: That portion of Third Street (formerly known as Te Point San Pedro.Road) and more particularly deseribed in the deed from William T. Coleman to the County of Marin recorded April 27, 1883 in the Marin County Recorder's Office in Liber Z of deeds at page 248 lying between the two following described lines. First: Beginning at a point on the northerly line of Third Street (Point San Pedro Road) distant thereon South 48° 081 East 42.00 feet and South 390 151 East 18.88 feet from the south - (c,, -„p. westerly corner of the land conveyed by the San Rafael Development Company to the San Rafael High School District by deed dated October 23, 1923 and recorded in the Marin County Recorder's Office in Book 29 of Official Records; At page 459 thence leaving the said northerly line of Third Street North 660 171 West 23.32 feet and North 640 231 West to a point in the southerly line of Third Street. Second: Beginning at a point on the northerly line of Third Street (point San Pedro Road) distant thereon North 780 491 West 118.90 feet and North 870 521 West 51.76 feet from the northwesterly corner of Third Street and Embareadero Way thence leaving the said northerly line of Third Street, South 660 171 East to a point in the southerly line of Third Street, SECOND: BEGINNING at a point on the northerly line San Rafael Canal at'the North- easterly corner of that certain strip of land conveyed by the San Rafael Development Company to the City of San Rafael by deed recorded March 3, 1920, in the Marin County Recorder's MARTINELLI & GARDINER Office in Book 212 of Deeds at page 204; thence along the ATTORNEYS ATNortherly line of the said strip of land, North 76° 301 ALBERT BUILDINGING SAN RAFAEL, CALIFORNIA 2 MARTINELLI & GARDINER ATTORNEYS AT LAW ALBERT BUILDING BAN RAFAEL, CALIFORNIA 3011 West 170 feet to a point thereon; thence leaving the Northerly line of the San Rafael Canal, North 150 191 East to the Southerly line of Third Street (Point San Pedro Road); thence following the said Southerly line of Third Street, Southerly and Easterly to the Northwesterly corner of that certain parcel of land conveyed by Sam Smith, et al, to the San Rafael High School District by deed recorded June 1, 1932, in the Marin County Recorder's Office in Book 249 of Official Records at page 240; thence following the Westerly line of the last mentioned parcel of land, South 20 41' West 38.11 feet to the point of beginning. a `-Z-A eertii'71 113!' the fnr ,1ni.*./�-r-Nnhr?inn was duly rind re1710 fat c,L r -A `'10L -f -k the Council of xaid ---------------- n ! — - (� r 'he follomt.,.,, to-zuit: A-wes , CourAlmen Hees e Courr�almen � Absent.
