RESOLUTION APPROVING AND CONFIRMING AMENDED ASSESSMENT IN THE MATTER
OF RESOLUTION OF INTENTION NO. 422.
WHEREAS, MONDAY, the 34hday o��,1934, at the
Council Chambers of the City Council of the City of San Rafael at the
City Hall in said City at the hour of eight o'clock P.M. of said day
has been fixed as the time and place when and where all persons inter-
ested in the original diagram assessment numbers 235, 236 and 237,
being a portion of assessment number 16. made pursuant to said resol-
ution of intention, or in the land affected thereby or in the bonds
secured by issuance thereon or secured by the lien of said assessment,
which said assessment was approved by the Council of said City on the
7th day of June, 1929, may appear and protest against said amended
assessment, said resolution of intention and said original assessment
being hereby referred to for a description of said work for a more
detailed description of said assessment.
WHEREAS, it appears to said Council that certain real
property included within said original diagram and assessment numbers
235,236 and 237 have been subdivided since the making of said original
assessment; and portions thereof have been transferred and the owner-
ship of portions thereof bas been transferred to persons other than
the owner or inners of said original parcels; and

WHEREAS, on the 5th day of March, 1934, said City Council
did order and direct the City Superintendent of Streets of said City
to file with the Clerk of said Council an amended assessment of said
original parcels of land segregating and apportioning the unpaid in-
stallments of said original assessments in accordance with the benefit
to said portions, as said original parceLls; and
WHEREAS, said Superintendent of Streets pursuant to
said order did on the 17th day of May, 1934, file with the Clerk of said
City a report and amended assessment of the real property subject to and
designated by said original diagram and assessment:niimbers 235, 256 and
237 as appears in the assessment for the work and improvement done
and made pursuant to resolution of intention No. 422 aforesaid; and it
appearing to the said Council that there was annexed to said report and
amended assessment and made a part thereof a map or plat showing how
said parcels of land had been divided; and
WHEREAS, it appears to said Council and said Council
hereby finds that notice of the time and place of said hearing referring
foregoing
to the,,m tters was given by the Clerk of said legislative body by
publication in the San Rafael Independent for the time and in the
manner provided by law which said notice did contain all of the matters
and statements required by law to be set forth therein, and that the
time so fixed for said hearing is and was not less than fifteen (15)
days from the first publication of said notice, which said first pub-
lication was on the 11 day ofeju l l'j , 1934, as appears from the
affidavit of publication thereof on file in the office of said Clerk; and

WHEREAS, said Council duly met at the time and place
then mentioned and the matter of said report and amended assessment
and the hearing thereupon and the bearing and determining of all
objections to the division of such assessment duly and regularly came
on for hearing before said Council;
And it appearing to the Council and the Council finds
that no protests,appeals or objections of any kind or character against
said amended assessment or any of the matters appertaining thereto have
been made, filed or presented as required by law or otherwise, or at all,
and said Council being satisfied with the correctness and legality of
said report and amended assessment and the division of said assessment
and diagram numbers 235, 236 and 237 and the segregation and apportionment
of the unpaid installments of said original assessment in accordance with
the benefits to said portions of said original parcel;
And it appearing to said Council that the unpaid install-
ments of said original assessments have been segregated and rportionSe�d

among and upon the re^pective subdivisions or r rtions 6f saidforiginal
assessments in accordance with the benefit to said portions thereof
respectively and that said re -assessment and amended assessment ought to
be confirmed;
NOW THMEFORE, IT IS HEREBY ORDERED AND RESOLVED by said
City Council that all of the acts and determinations of said Superintendent
of Streets in relation to said amended assessment and the segregation and
apportionment of the unpaid installments thereof be and the same are
her( -:by confirmed, and said amended assessment and all matters pertaining
thereto so filed tith the Clerk of said City on the 17th day of May,
1934, and the plat or map annexed thereto are hereby found and determined
to be correct and are hereby ratified, approved and confirmed;
IT IS FURTHER ORDERED AND RESOLVED that the Clerk of said

assessment with the auditor of said City and that said auditor shall
annually hereafter enter upon the assessment roll of said City the
installments becoming due on each component part of the original
parcel opposite a description of the respective portions or parcels
so assessed.
Except as hereinabove otherwise provided all of the
above referred to work shall be dnn.e in pursuance of the acts of the
Legislature of the State of California designated the "Improvement Bond
Act of 1915' and all amendments thereto.
