RESOLU'1'IOiV DIRECTING PUBLICATION OF N OiICE
r'OR SEALED BIDS FOR THE LLASIN G OF ThE aAN
RAFAEL MUNICIPAL BATHS PAVILION.

WHEREAS, the City of San Rafael is the owner of
that certain two story wooden frame structure with stucco
finish situate on the southerly line of Third Street in
the City of San Rafael commonly known as "San Rafael Batbs";
WHEREAS, for many years last past said San Rafael
Baths has been operated at a financial loss; and
WHEREAS, for many years immediately last past said
building has not been oper+ted or devoted to use as a public
baths but has been a constant expense to said City;
WHEREAS, there has been and is insufficient public
patronage to warrant or make possible the maintenance of
a public baths thereat;and
WHEREAS, said City is under constant expense
in the maintenance of said building and the same will by
reason of disuse fall into delapidation and disrepair,
WHEREAS, said building together with the land upon
which the same is situate was not acquired, purchased,
donated or, otherwise received by said City for public park
or public library purposes;
WHEREAS, it appears to said City Council and said
City Council finds that it is to the best interest of said City
to lease said structure to private persons, firms or corporations
and to derive an income therefrom,
NOW THEREFORE, IT IS IH;REBY RESOLVED by the City
Council of the City of San Rafael that it is for the best
interest and advantage of said City that said building be leased
to the person, firm or corporation offering the highest total
rental sum therefor.
IT IS FURTHER RESOLVED that it is impracticable and
NO
unprofitable to maintain said buiding and premises as a public
bathe.
IT IS r'URTHER RESOLVED that the City Clerk of said City be
and he is hereby authorized a•nd directed to cause to be published
a notice calling for sealed bids or proposals for the leasing
of said building in its entirety.
BE IT FURTHER RESOLVED that said City Council has
agreed upon the proposed terms of said lease except rental and
that a form of said proposed lease is on file in the office of

said City Clerk and that said notice calling for sealed proposals
shall refer to said lease on file and shall direct the attention
of all bidders thereto and shall contain a statement that all
bids shall be upon the terms and provisions of said lease on file
excepting as to the amount of rental.
BE IT FURTHER RESOLVED that said notice shall be published
at least once a week for two weeks, to -wit, by three successive
publications in the Marin Journal, a weekly newspaper of general
circulation circulated, printed and published in said City and -chat
said notice shall further provide that said City Council reserves
