RESOLUTION GOVERNIIIG TIM USE CP CITY OM -ED GASOLINE.
11F.AS in the opinion of some of the members of the City Council, City
avined gasoline has been used without refgards for the interests of the people of
San Rafael.

BE IT RESOLVED that aster the 10th day of November, 1936 no City awned
gasoline C&eelrim be delivered or taken from the City's gasoline pump, for other than
City owned vehicles: b; any City's Governing body or a,:.;, other body without parties

receiving same furnishing an affidavit duly signed and sworn to before a Notary
authorized to take same, That no part or parcel theroof has been used for any purpose

whatsoever except for the benefits of said City.
It was moved by Councilmen Grady and seconded by Councilman Barges that
the above resolution No. 661 be adopted. Upon the question being put by the Mayor a
roll call was had upon the notion.

The vote was had and taken as follows, to wits Councilman Bates voted
"Nop" Councilman Borges voted "Yes: Immediately upon the name of Councilman Dutton
being called by the Clerk on roll call, and prior to casting ',:pis vote, Councilman Bates
publicly challenged the vote of Councilman Dutton upon tht motion upon the grounds that
he had ceased to be and was not a resident within the City of San Rafael. After the
Clerk had entered the challenge in the Minutes, Councilman Dutton purported, to vote "Yeas".-
Counoilm n. Grady voted "Yee" and Mayor Riede voted. "No". Thereupon the Mayor declared
that the challenge made by Councilman Bates to the vote of Councilman Dutton was allowed
upon the grounds stated and thereupon proceded to d6olare they result of the ballot.
The Mayor announoed that the motion had lost and failed to carry.
NOTE
The above matter of Dutton's legality as a resident was settled in the Superior
Court in favor of Mr. Dutton.
