7 Resolution Number . RESOLUTION AUTHORIZING AND DIRECTING CITY ENGINEER AND CITY ATTORNEY TO INSTITUTE PROCEEDINGS FOR PERMISSION TO CONSTRUCT A PUBLIC HIGHWAY ACROSS A 1ILROAD. ------------------------------ WHERE.�S, heretofore the City of San Rafael has c�usec certain improvements to be done and made upon Lindar© Street in the City of San Rafal between Second Street and Woodland Avenue in said City by the construction of certain fill and other improvements so as to pre- pare the same for vehicular traffic thereon; WHEREAS, said public street intersects and crosses the right of wc�y of the NORTH' STERN PLCIFIC RV�=ILROLD CC:._ ANY at a point between "B" Street and Union Depot in said City; WHEREAS, public interest, convenience and necessity of the City of San Rafael and its residents re uire the completion of said improvement and the grading and surfacing of said street so as to permit of vehicular traffic thereon; WHEREAS, it is necessary in order to complete said work and improvement that said public street be constructed across the right of way and railroad tracks of said Railroad Company; NOW THEREFORE, BE IT HERLBY RESOLVED by the City Council of the City of San Rafael that said City shall institute and prosecute and does hereby authorize the institution and prosecution of the proceedings required by that certain Act of the Legislature of the State of California designated as Act 6386, approved A,)ril 23, 1915, Statutes of 1915, page 115, and all acts amendat�o ..to ereof and supple- mental thereto in order to obtain the permission of Railroad Commission of the State of California to construct said public street across said railroad right of way. BE IT FURTHER RESOLVED that the City Engineer and City Attorney of said City be and they are hereby authorized and directed to prepare an application to said Railroad Commission for permission to construct said public street across said railroad crossing which said ap-)lication shall be in the form and shall contain the matters required by the rules of procedure governing formal proceedings before the Railroad Commission of the State of California and particularly Rules Sixteen, Seventeen, Eighteen, Ninetoen, Twenty and Thirty-one thereof.
