March 2024 City of San Rafael SERVICE LEVEL AGREEMENT DATED JUNE 19, 2023 WITH BKF ENGINEERS TASK ORDER NO. 145 Subject title: Topographic Survey for South Merrydale – Civic Center Pathway Task Order Amount: $36,665 THIS TASK ORDER is entered into on ____________________ between the City of San Rafael, a municipal corporation ("City"), and BKF ENGINEERS, ("Contractor"). RECITALS A. Whereas Master Consultant Services Agreement is hereby renamed Service Level Agreement; and B. The City and Contractor (as may be identified as “Consultant” in the original Agreement) have entered into a Service Level Agreement ("Agreement") dated June 19, 2023 under which Contractor has agreed to perform certain contract services for the City; and C. Pursuant to the terms of the Agreement, the City wishes Contractor to perform certain tasks as set forth in this Task Order, which constitute the Work; NOW, THEREFORE, City and Contractor agree as follows: AGREEMENT 1. Scope of services. Contractor shall provide any and all of the services set forth in Exhibit A of this Task Order, for an amount not to exceed the Task Order Amount, identified above, as directed by the City. Jason Kirchmann shall be the Project Manager for Contractor for this Task Order. Additional contract services may be performed by other Contractor staff with prior notice and approval by City. a. City's duties. The City will: (1) Determine the scope of services, as set forth in Exhibit A. (2) Make available work plans and specifications and other City data related to the project, including full information as to the City's requirements. (3) Designate Grey Melgard, or their designee as the person at the City responsible for monitoring performance under this Task Order. b. Contractor duties. The Contractor will: (1) Provide and perform tasks identified in Exhibit A, Scope of Services. (2) Provide miscellaneous services related to the Work and not stipulated elsewhere in this Task Order, when requested by the City in writing. A Task Order Amendment is Mar 4, 2025 City of San Rafael Service Level Agreement Task Order Rev. March 2024 required if these additional services cannot be performed within the Task Order budget. 2. Date of completion; Work hours estimate; Cost estimate and budget; Fee schedule: Costs are not- to-exceed stated Task Order Amount in this Task Order. See Exhibit A for Work and fee schedule details. 3. Authorization to proceed. The City will give Contractor authorization to proceed with the work specified in this Task Order only after Contractor submits updated insurance certificates and endorsements, in accordance with the Agreement. 4. Service Level Agreement terms; Conflicts. Except as expressly otherwise provided herein, all terms of the Agreement shall apply to Contractor in the performance of work pursuant to this Task Order. If there is a conflict between this Task Order and the Agreement, this Task Order shall control. 5. Amendment of Task Order; Conflicts. Except as provided in Section 1(b)(2) above, this Task Order may not be modified except by an Amended Task Order executed and approved in the same manner as the Task Order. 6. Signatures. TASK(S): DESCRIPTION: In general, BKF will perform the following tasks: 1.Design-Level Topographic Survey: BKF will provide a topographic survey that identifies visible site features, significant building corners, curbs, concrete gutters, edge of pavement, walkways, concrete pads, retaining walls, paint striping, signage, fences, rail lines, trees 6-inches in diameter and larger, drainage swales, and visual utility infrastructure. We will obtain a succession of spot elevations to define the general terrain of the project site. Visible utility infrastructure within the mapping limits, including sewer, water valves, hydrants, meter boxes, storm drain and marked utilities encountered during the course of our field survey will also be identified. Invert elevations on accessible manholes and storm drain inlets will be located. Underground utility locations may be shown on the mapping based on visual surface evidence and as- built drawings provided to BKF prior to commencement of the survey. The topographic survey will include spot elevations and 1-foot contours. The vertical datum will be based on the North American Vertical Datum of 1988, and the horizontal datum will be assumed to a tertiary level of accuracy. It is understood that the Survey Area falls within the Sonoma-Marin Rail Transit District right-of-way, and is below a CA-101 overpass. BKF will coordinate access with the Sonoma-Marin Rail Transit District for mapping access, but does not anticipate needing access to the CA-101 right-of-way in performance of this survey. Additional railroad safety staff is not included in this Task. 2.Boundary Recovery: BKF will recover the record boundary of Merrydale Avenue, Caltrans and the Sonoma-Marin Rail Transit District right-of-way within the Survey Area based on publicly recorded mapping and found monumentation shown thereon. Based on a cursory review of publicly available records and informal inquiries with other local surveyors, it is possible, but unknonw if sufficient existing monumentation exists and without material discrepancy to survey said boundaries without additional services or the requirement to file a Record of Survey in accordance with Section 8762 of the California Professional Land Surveyor’s Act. A Record of Survey is not included in this Task. BKF will set sufficient monumentation to retrace the survey and the Record of Survey will be submitted to the Marin County Surveyor’s office for recording and filing. County fees are not included. B.SMART Control/Datum: SMART has it’s own unique survey control system. If requested, prior to the commencement of field surveying, BKF will occupy SMART’s published control and will translate the mapping described herein onto said control to a Third Order level of accuracy. C.Rail Safety Staff: If SMART or other regulatory agencies require dedicated railroad safety staff such as an “Employee-In-Charge” (EIC), or equivalent, BKF will provide the staff while our field crews are working within the railroad right of way. Fees under this subtask include reimbursable expenses to update staff licensing and education for this service.
