HomeMy WebLinkAboutZoning Administrator Hearing 2024-07-24 Minutes SAN RAFAEL ZONING ADMINISTRATOR REGULAR HEARING July 24, 2024 Minutes and Notice of Decision (Pursuant to San Rafael Municipal Code 14.28.050) 10:03 -10:20 am 1. 75 Bellam Boulevard (Marin Square) – Request for a Use Permit to operate an all-ages establishment with pay-to-play arcade games and pool tables at 75 Bellam Boulevard, Suite H (Arcade Zone); APN: 018-051-20; General Commercial (GC) Zone; Orlando Perez, Applicant; Chelsea Pacific Investments LP, Owner; Case Number(s): PLAN24-013/UP24-011 Project Planner: Renee Nickenig PERMITS REQUIRED • Conditional Use Permit (UP24-011). Pursuant to San Rafael Municipal Code (SRMC) Section 14.05.020, the inclusion of arcade games and pool tables requires a Conditional Use Permit approved by the Planning Commission in the General Commercial (GC) zoning district. Pursuant to SRMC Section 14.22.020, the Community and Economic Development Director has determined that the proposed use does not warrant the designated level of review and as such will be acted on by the Zoning Administrator. PROJECT DESCRIPTION The project proposes to operate an all-ages establishment with pay-to-play games at 75 Bellam Boulevard (Marin Square), Suite H. The proposal includes the installation of two (2) pinball machines, two (2) pool tables, six (6) foosball tables, and two (2) a ir hockey tables. The use program would include limited food sales of pre -packaged items. The proposal does not include any additional food service or preparation, and no alcohol would be sold or permitted on-site. The proposed hours of operation are 10:00 am to 11:00 pm, seven (7) days a week. The program would intend to not admit minors during school hours, estimated to be between 8:30 am to 3:00 pm Monday through Friday, August through June. The establishment would be additionally available for rental to hold small -scale events. No amplified sound is included in the business description. PUBLIC HEARING On July 24, 2024, a Zoning Administrator meeting was convened for this Conditional Use Permit (UP24-011). The Zoning Administrator for this meeting, Margaret Kavanaugh- Lynch, opened the meeting at approximately 10:03 am. Planner Presentation The Project Planner, Renee Nickenig, provided a brief overview of the project. B. Applicant presentation The applicant was present, but did not give an additional presentation. C. Public Comments A member of the public was present to ask clarifying questions in support of the project applicant and noted an intention to assist in the final stages of the process. D. Zoning Administrator Discussion The Project Planner, applicant, a representative for the applicant, the member of the public, an additional staff member, and the Zoning Administrator participated in an open discussion of the project and the security recommendations provided by the San Rafael Police Department. E. Action The Zoning Administrator Conditionally Approved the request for a Conditional Use Permit (UP24-011). The conditions of approval included in the staff report are included as part of the Zoning Administrators decision. The meeting was adjourned at approximately 10:20 am. This Notice of Zoning Administrator decision is provided in compliance with SRMC Section 14.28.050 - Notice of decision. Any aggrieved party may appeal this decision pursuant to SRMC Section 14.28.030 - Filing and time limit of appeals, by submitting a letter of appeal and the appropriate fees within five (5) working days of the date of approval, or by July 30, 2024 at 5:00 p.m. This approval shall become effective at the end of the appeal period.
