HomeMy WebLinkAboutCC Resolution 15389 (Workers Compensation Claims Agreement Amendment)RESOLUTION NO. 15389 RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE SECOND AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH LWP CLAIMS SOLUTIONS, INC, FOR WORKERS’ COMPENSATION CLAIMS ADMINISTRATION SERVICES, INCREASING THE TOTAL NOT TO EXCEED AMOUNT UNDER THE AGREEMENT TO $1,745,311, SUBJECT TO APPROPRIATION, AND EXTENDING THE TERM DATE JUNE 30, 2026 WHEREAS, on April 2, 2018, the City Council authorized the City Manager to enter into a Professional Services Agreement with LWP Claims Solutions, Inc., to provide workers' compensation claims administration services, effective May 1, 2018, with a total not to exceed amount of $904,089 for a five-year term; and WHEREAS, on May 1, 2023, an informal First Amendment to the Agreement was entered into to extend the term of the Agreement through April 30, 2026, and to increase the not to exceed amount under the Agreement to $1,490,915; and WHEREAS, it has been determined that an additional extension of the Agreement term through June 30, 2026, is necessary to align the professional services agreement with the City’s fiscal year, and to ensure continuity of services for ongoing workers' compensation claims; and WHEREAS, staff recommends executing a Second Amendment to add $254,396 to the agreement and adjusting the term, extending it to June 30, 2026, and increasing the total not to exceed under the Agreement to $1,745,311 ; and WHEREAS, staff recommends authorizing the expenditure of $254,396 for third party workers’ compensation administrative services through June 30, 2026; and WHEREAS, funding to cover the extension and additional fees will be covered by appropriations in the Non-Departmental FY 2025-26 budget, and through the Workers’ Compensation Fund (Fund 606) for FY 2025-26; and WHEREAS, the City desires to maintain continuity of service for workers’ compensation claims, ensuring efficient claims management, cost control, and compliance with regulatory requirements, and to support City staff in managing these claims effectively. NOW, THEREFORE BE IT RESOLVED, that the City Council hereby finds that the foregoing recitals are true and correct and authorizes the City Manager to execute the second amendment to the Professional Services Agreement with LPW Claims Solutions, Inc., increasing the total not to exceed amount under the Agreement to $1,745,311, subject to appropriation, and extending the term date June 30, 2026.
