BACKGROUND: On September 3, 2024, the City Council adopted Resolution No. 15339, updating the City’s Conflict of Interest Code for Designated Employees in compliance with requirements set forth by the Fair Political Practices Commission (FPPC). Pursuant to this code, all designated employees and consultants are required to file an annual FPPC Form 700, Statement of Economic Interests, by April 1 of each year. The purpose of this filing is to promote transparency and prevent conflicts of interest by requiring public officials and designated employees to disclose their financial interests. Filing of the Form 700 ensures that decision-making is conducted in the public’s best interest, in compliance with the California Political Reform Act. ANALYSIS: For the 2024 filing year, 98% of designated employees and consultants filed their Form 700s on time. Two consultants have not yet submitted their forms and are currently subject to late penalties under FPPC regulations. The City Clerk’s Office has issued the first of two formal non- filer notifications to these individuals. As part of its compliance review, the City Clerk’s Office conducted a 20% random audit of on- time filings and a 100% review of all late submissions. No amendments were required as a result of this review. All submitted forms are publicly available for review in the City Clerk’s Office and on the online. In addition, beginning January 1, 2025, the FPPC now requires all 87200 filers—including the Mayor, City Councilmembers, City Manager, City Treasurer/Finance Director, and City Attorney—to file directly through the FPPC’s electronic filing system. While these filings are no longer processed through the City Clerk’s Office, staff has manually uploaded copies to the City’s transparency portal to ensure continued local access for San Rafael residents. All 87200 filers submitted their forms by April 1, 2025, deadline. One Planning Commissioner filed after the deadline and has since come into compliance. ATTACHMENTS: None.
