Purpose of the Hearing
On February 27, 2025, the City of San Rafael received a timely
appeal to the City Council of the Planning Commission’s decision
to approve a request for reasonable accommodation at 131
Valley View Avenue.
Chronology
October 17, 2024 –Administrative Approval of Reasonable Accommodation Request
October 21, 2024 –Appeal to the Planning Commission
February 25, 2025 –Planning Commission Approval of the Reasonable Accommodation Request
February 27, 2025 –Appeal to the City Council
Appeal Summary
1. Appellant: There is no nexus between the disability and the
requested accommodation.
Staff Response: City staff, through detailed conversations with the Applicant, determined
that the disability of one of the residents of 131 Valley View is directly related to the
requested accommodation.
2. Appellant: The City failed to investigate potential alternative
designs.
Staff Response:Considering the potential costs to an applicant, potential costs to members
of the public, and potential costs to the City, the City justifiably concluded that no alternative
accommodation would provide an equivalent level of overall benefit as the proposed design
of the approved reasonable accommodation.
3. Appellant:The fire hazard risk posed by the reasonable
accommodation is too high.
Staff Response: Existing fire safety laws and building codes already in place minimize the
fire risks associated with the Project, so there is no basis under which the City could find
make this finding.
4. Appellant:The Appellants have been denied due process.
Staff Response: The City has properly complied with all applicable local, state, and federal
laws in processing the reasonable accommodation.
Staff Recommendation
Staff recommends the City Council adopt the resolution to deny
the appeal and uphold the Planning Commission’s approval of a
reasonable accommodation request at 131 Valley View Avenue.
