HomeMy WebLinkAboutPW Service Level Agreement; Mountain F. Enterprises, Vegetation Management1 FIRST AMENDMENT TO THE SERVICE LEVEL AGREEMENT WITH MOUNTAIN F. ENTERPRISES, INC. FOR VEGETATION MANAGEMENT SERVICES THIS FIRST AMENDMENT to the Service Level Agreement by and between the CITY OF SAN RAFAEL (hereinafter “CITY”), and MOUNTAIN F. ENTERPRISES, INC. (hereinafter “CONTRACTOR”), is made and entered into as of _________________________. RECITALS WHEREAS, the CITY and CONTRACTOR entered into a Service Level Agreement dated February 20, 2024 to perform services in connection with CITY’S vegetation management, for an annual not-to-exceed contract amount of $1,000,000 (the “Contract”); and WHEREAS, under the terms of the Contract, the Term of the Contract was to expire on February 20, 2025; however the CITY and CONTRACTOR agreed that at the CITY’s election, the Contract may be extended three times, each for a period not to exceed one year, and now wish to extend the Contract; AMENDMENT TO CONTRACT NOW, THEREFORE, the parties hereby agree to amend the Contract as follows: 1.Article 4 of the Contract, entitled “TERM” is hereby amended, effective as of February 20, 2025, to extend the Contract term by one (1) year, through February 20, 2026. 2. Except as specifically amended herein, all of the other provisions, terms and obligations of the Contract between the parties shall remain valid and shall be in full force.
