HomeMy WebLinkAboutFin Proposed Update to Master Fee Schedule for Fiscal Year 2025-26____________________________________________________________________________________ FOR CITY CLERK ONLY Council Meeting: 06/02/2025 Disposition: Resolution 15421 Agenda Item No: 8.a Meeting Date: June 2, 2025 SAN RAFAEL CITY COUNCIL AGENDA REPORT Department: FINANCE Prepared by: Paul Navazio, Finance Director City Manager Approval: ______________ TOPIC: PROPOSED UPDATE TO MASTER FEE SCHEDULE FOR FISCAL YEAR 2025-26 SUBJECT: RESOLUTION UPDATING THE CITY’S MASTER FEE SCHEDULE FOR FISCAL YEAR 2025-26 EXECUTIVE SUMMARY: This report has been prepared for the City Council to consider fee increases above the automatic CPI- based adjustment for selected programs and services, as required to meet target cost recovery levels (primarily in Building and Planning services and Recreation programming). The target cost recovery level (primarily related to ambulance transport fees) is also recommended to be increased. Other adjustments to the Master Fee Schedule are proposed to align fee structures with current program and service offerings and eliminate outdated and obsolete fees. This report summarizes the changes incorporated through the proposed update to the City’s Master Fee Schedule. Attachment 4 provides a redline version of the proposed revisions to the Master Fee Schedule document. Exhibit A (Attachment 2) and Exhibit B (Attachment 3) provide “clean copies” of the FY 2025- 26 Master Fee Schedule, consistent with the recommendations included in this report. RECOMMENDATION: Staff recommend that the City Council adopt a resolution authorizing an update to the City’s Master Fee Schedule for fiscal year (FY) 2025-26 to adjust fees for selected programs and services where fee increases beyond previously approved increases based on specified Consumer Price Index (CPI) are required to meet and maintain target cost recovery levels. BACKGROUND: In December 2022, following a comprehensive rate study, the City Council adopted a resolution authorizing updates to its Master Fee Schedule, with approved fees becoming effective July 1, 2023. Furthermore, the adopted resolution authorizes annual fee increases, based on annual increases in the San Francisco-Oakland-Hayward All Urban Consumers’ Price Index (CPI-U), not to exceed 3.0% per year. These automatic (CPI-based) fee increases were established to take effect as follows: SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2 • Childcare Fees – August 2025 (Concurrent with the start of the 2025-26 school year) • Recreation Fees – January 1, 2026 • All Other Fees – July 1, 2025 Fee schedule updates ensure that the City operates sustainably and recovers costs for programs and services, including plan review, building and fire inspections, and use of the public right-of-way. State law, including Propositions 26 and 218, provides explicit guidance and restrictions on allowable rates, which are capped at 100% cost recovery for most fees. Some fees in the Master Fee Schedule are set below the level required for full cost recovery, typically when the program or services are deemed a public benefit. As part of developing the FY 2025-26 budget, staff have reviewed the fees included in the Master Fee Schedule to identify fees where built-in CPI-based annual increases were insufficient to maintain target cost recovery levels. Specifically, the February-to-February increase in the referenced CPI was 2.70%. By comparison, costs associated with selected City programs increased by more than the rate of inflation, largely due to personnel cost increases resulting from negotiated labor agreements with the City’s represented and unrepresented bargaining groups. Revisions to the Master Fee Schedule fall within specific categories. • Master Fee Schedule revisions requiring City Council action: o Proposed fee increases that exceed the authorized CPI-based adjustment o New fees recommended to be added to the Master Fee Schedule • Master Fee Schedule revisions that do not require City Council action: o Fees where no change is proposed o Fees being increased consistent with the pre-approved CPI-based adjustment (2.70%, rounded to the nearest dollar) o Fees being eliminated (where the City no longer provides a specific service) While formal City Council action is only required in cases where a) a proposed increase to an existing fee exceeds the authorized CPI-based increase and b) a new fee is being proposed, other changes are highlighted in this report for maximum transparency. Among the items clarified in this update to the City’s Master Fee Schedule is the inclusion of the explanation, where applicable, to how the City calculates Fully Burdened Hourly Rates (FBHR) for fees recovering staff costs. Specifically, the Master Fee Schedule provides that FBHR’s are based on average base pay for applicable classifications, plus the citywide fringe benefit rate, plus citywide 10% overhead rate. ANALYSIS: This section of the report summarizes changes being proposed for the FY 2025-26 update to the City’s Master Fee Schedule. 1. General Service Fees Master Fee Schedule revisions within the General Services category include fees where no change is proposed and proposed increases are consistent with CPI-based adjustments (2.70%, rounded to the nearest dollar). Police Service Fees Master Fee Schedule revisions within the category of Police Services include fees where no change is proposed, and the establishment of a new fee category. The new fees are being proposed as part of the FY 2025-26 Master Fee Schedule Update and include the addition of the Rotation Towing Services category pursuant to City Council Resolution 14206 (adopted October 2016), with proposed fee adjustments that align with current Marin County/California Highway Patrol (CHP) rates. Please refer to Attachment 2, page 2, for proposed revisions to this section. 3. Library Service Fees No changes are proposed for fees within Library Services. 4. Fire Service Fees Master Fee Schedule revisions within the category of Fire Services include fees where increases are proposed, across-the-board, consistent with CPI-based adjustments (2.70%, rounded to the nearest dollar), and eliminating one fee where service is no longer provided. In addition, the Fire Department recommends increasing the fees charged for Emergency Medical Services to reflect, a) increased costs related to personnel salary and benefits and b) increasing the target cost recovery level to full cost recovery (100%) from 75% based on comparative rates charged within the market. Please refer to Attachment 2, pages 4-6, for proposed revisions to this section. 5. Building and Safety Service Fees Master Fee Schedule revisions within the category of Building and Safety Services include fees where no change is proposed, proposed increases are consistent with CPI-based adjustments, modifications to fee descriptions, and the addition of fees. The latter primarily includes fees related to Massage Establishment Operator Permits. In addition, City staff recommends increases to certain fees above CPI of 2.70%. A comparison of recommended fee adjustments is included in Attachment 4 to this report. In general, the proposed fee adjustments are summarized as follows: • Valuation-Based Fees 3% increase • Software Integration & Support Fee 3% increase • Massage Establishment (Sole Proprietor) 3% increase • Hourly Inspection Fees 3.5% increase • Residential Building Reports 7% increase • Massage Establishment (4+ Employees) 237% increase SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 4 Fees for massage establishments with four or more employees are proposed to increase this significantly in order to achieve full cost recovery (100%); therefore, the fee increase of $703 have been calculated to reflect the costs associated with increasing inspections and enforcement of Chapter 10.90 of the San Rafael Municipal Code. Currently the fees are woefully inadequate to conduct the code enforcement operations needed to ensure compliance. Please refer to Attachment 2, pages 7-8, for proposed revisions to this section. 6. Planning Service Fees Master Fee Schedule revisions within the category of Planning Services include fees where no change is proposed, modifications to fee descriptions, and the addition of fees. The latter includes the addition of fees that are specific to cost recovery of staff time for reviews and entitlements performed. In addition, City staff is recommending a 5.00% increase to all fees based on a review of program costs in relation to cost recovery targets and an analysis of comparable rates charged within the market. Please refer to Attachment 2, pages 9-10, for proposed revisions to this section. 7. Mechanical, Electrical, and Plumbing Permit Fees In prior years, the Master Fee Schedule separated the Mechanical, Electrical, and Plumbing permit fee categories. The proposed revisions include combining these categories into one exhibit and consolidating individual permit fees (e.g., cost per electrical outlet) with the established minimum permit fee. In addition, Master Fee Schedule revisions within this revised category include modifications to fee descriptions and the elimination of fees where the specific service is no longer provided. Please refer to Attachment 2, pages 11-17, for proposed revisions to this section. 8. Recreation Program Fees Recreation program fee increases are based on a review of program costs in relation to cost recovery targets, along with an analysis of comparable rates charged within the market. In 2024, the Council authorized annual fee adjustments based on the Feb-to-Feb All Urban Consumer Index (CPI-U) for San Francisco/Oakland/Hayward. After reviewing market rates and the desired cost recovery targets, staff recommend a 5% increase effective January 1, 2026. Recreation fees are rounded to the nearest whole dollar for administrative efficiency. Since certain Recreation Division Fees would remain unchanged due to rounding, some fees have been rounded to the next highest whole dollar (e.g., pool drop-in fees). Consistent with past direction from the City Council, selected fees for programs and facilities provided at Pickleweed Park and Boro Community Center are set at 50% of the rates of other facilities. Please refer to Attachment 2, pages 18-20, for proposed revisions to this section. 9. Child Care Fees Childcare fee increases are based on a review of program costs in relation to cost recovery targets, along with an analysis of comparable rates charged within the market. While the Childcare Fund generally achieves less than full cost recovery, personnel costs for FY 2025-26 are expected to exceed the program revenues. For FY 2025-26, the Childcare Fund is proposed to include expenditure appropriations of $3.52 SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 5 million and revenues of $3.34 million. The Childcare Fund will require $176,000 in available fund balance to cover the shortfall. Program Area Proposed Change Effective Date Childcare - Afterschool Programs 5% increase August 1, 2025 Childcare – Parkside Preschool Tuition and Summer Kids Camp 10% increase August 1, 2025 A 5% fee increase is proposed to address rising program costs for Afterschool Program Fees, day use, and registration fees. A 10% increase is proposed for Parkside Preschool Tuition and Summer Kids Camp program fees. Despite these fee increases, City of San Rafael Childcare program fees are expected to remain lower than those of most regional providers for similar services. Pickleweed Preschool is a State-subsidized, part-day program, so it is not affected by these fee updates. Another change reflected in the Fee Schedule is the consolidation of Afterschool Program Fees to a standard fee schedule. In recent years, the Miller Creek School District (MCSD) and San Rafael City School District (SRCS) changed their bell release schedules and offerings for Transitional Kindergarten and Kindergarten programs. Historically, the program maintained slightly different fees due to significant differences in the daily, weekly, and annual number of program hours offered at each school district. However, those differences no longer exist due to changes to school hours of operation. This change would standardize the Childcare Afterschool Program Fees across school districts. This change will lead to a simpler fee schedule, more consistency across program sites, and reduced administrative complexity. Please refer to Attachment 2, page 20, for proposed revisions to this section. 10. Public Works Service Fees Master Fee Schedule revisions within the category of Public Works Services include fees where no change is proposed, and increases are proposed consistent with CPI-based adjustments. Please refer to Attachment 2, pages 21-22, for proposed revisions to this section. This section includes fees for the City's Streetaries program. City staff will propose an economic vitality incentive program at the June 23, 2025, City Council meeting to support local businesses by offsetting some of the costs associated with maintaining a compliant streetary. 11. Administrative Citation Fees Master Fee Schedule revisions within the category of Administration Citation Fees include fees where no change is proposed and the addition of fees. The latter is the addition of an Administrative Citation Fee pursuant of our Municipal Code Chapter 8.19, “Social Host Ordinance,” and cost aligns with other established public nuisance citation fees. Please refer to Attachment 2, pages 23-25, for proposed revisions to this section. 12. Sewer and Drainage Fees There are no changes proposed for fees within Sewer and Drainage Fees. PUBLIC NOTICE: The City provided notice of this public hearing and the proposed update to the Master Fee Schedule, and information was made available to the public in advance of the hearing in accordance with Government Code Sections 66016 through 66018. ENVIRONMENTAL DETERMINATION: The proposed action is exempt from the California Environmental Quality Act (CEQA) per CEQA Guideline 15061(b)(3) in that it does not have the potential to significantly affect the environment. NEXT STEPS: Following adoption of the City’s Master Fee Schedule for FY 2025-26, staff will continue to evaluate fees across all program areas to achieve cost-recovery, as appropriate, as well as identify areas where fees can be established to reduce the burden of general fund tax revenues supporting programs and services benefiting specific users. This work includes undertaking a comprehensive review of Recreation Program Fees and related cost-recovery targets as well as updating the City’s development impact fee program. FISCAL IMPACT: The proposed changes to the Master Fee Schedule will increase revenue for the City; however, most CPI-based adjustments and increases aimed at maintaining existing cost recovery targets have been factored into the revenue estimates used to develop the FY 2025-26 budget. The proposed fee increases for the City’s Emergency Medical Services, which includes increasing the overall cost recovery level for this program, would result in an estimated $450,000 in additional revenues on an annualized basis and have been included in the Paramedic Fund revenues for FY 2025-26. OPTIONS: The City Council has the following options to consider on each of the resolutions: 1. Adopt the resolution as presented. 2. Adopt resolution with modifications. 3. Direct staff to return to the City Council with more information. 4. Take no action. RECOMMENDED ACTION: Staff recommend that the City Council adopt a resolution authorizing an update to the City’s Master Fee Schedule for fiscal year (FY) 2025-26 to adjust fees for selected programs and services where fee increases beyond previously approved increases based on specified Consumer Price Index (CPI) are required to meet and maintain target cost recovery levels. A RESOLUTION OF THE CITY COUNCIL UPDATING THE CITY’S MASTER FEE SCHEDULE FOR FISCAL YEAR 2025-26 WHEREAS, in December 2022, following a comprehensive rate study, the City Council adopted Resolution 15178, a resolution authorizing updates to its Master Fee Schedule; and WHEREAS, the Resolution No. 15178 authorizes annual fee increases, based on annual increases in the San Francisco-Oakland-Hayward All Urban Consumers’ Price Index (CPI-U), not to exceed 3.0% per year; and WHEREAS, an increase in fees for various City programs and services in excess of CPI is required to in order to maintain target cost-recovery levels based on FY 2025- 26 program costs; and WHEREAS, additional revisions to fee categories, descriptions and fee structures are proposed as part of the FY 2025-26 Master Fee Schedule Update; and WHEREAS, the addition of new fees are proposed to be included in the FY 2025-26 Master Fee Schedule Update; and WHEREAS, the City has calculated the fee amounts identified on Exhibit A (and described in the staff report accompanying this resolution) in accordance with the requirements of State law; and, particularly, the fees are exempt from the definition of “tax” as set forth in Proposition 26 (California Constitution Article XIII C, Section 1(e)) since the fee amounts: (a) do not exceed the proportionate reasonable cost to the City in providing the service or program to the person paying the fee, and (b) do not exceed the value of City property used by the person paying the fee.
