FEE SCHEDULE FISCAL YEAR 2025-2026 AND AUTHORIZING ECONOMIC

RECOMMENDATION:
Staff recommends that the City Council adopt a resolution revising “Streetary” and “Outdoor (Sidewalk)
Dining” fee categories, descriptions, and structures in the City’s Master Fee Schedule for fiscal year (FY)
2025-26 and authorizing economic incentives.
BACKGROUND:
Over the last ten years, the City of San Rafael has encouraged outdoor dining in the public right-of-way
as an economic development strategy to support local businesses and enhance Downtown’s vitality.
Outdoor dining can boost restaurant business by increasing seating capacity, drawing in foot traffic, and
providing a unique dining experience. Several cities across the state and nationwide have used outdoor
dining as a tool to invigorate their commercial areas, making them more vibrant to residents and visitors
alike. As outlined below, San Rafael’s approach to regulating outdoor dining has evolved since 2015 to
address restaurant trends, pandemic-era necessities, and post-pandemic conditions.
On August 17, 2015, the City Council adopted Resolution No. 13995, establishing a three (3) year “Street
Dining” pilot program which provided a process for businesses to use City parking spaces (now called
“Streetaries”) for outdoor dining purposes, consistent with existing requirements set out in San Rafael
Municipal Code (SRMC) § 14.17.110 and SRMC § 14.16.277. On December 3, 2018, the City Council
authorized Street Dining to continue “under the same limitations.” This program resulted in three (3)
merchants receiving approval to operate Streetaries in City parking spaces before the 2020 COVID-19
pandemic.
Following the declaration of a pandemic and Public Health Orders that restricted the use of indoor spaces,
on June 1, 2020, the City Council adopted Resolution No. 14809, which authorized temporary changes

to the Outdoor Dining procedures/provisions in the SRMC and reduce d and/or waived fees. This
authorization allowed restaurants to continue operating during a period in which Public Health Officials
prohibited or severely restricted indoor dining. Subsequently, in 2021, the City Council adopted the
Downtown Precise Plan, which contained recommendations to facilitate outdoor dining options, including
program 8B.2.8.
To formalize the Streetary program, the City Council adopted Ordinance 2016 on October 3, 2022, which
outlined requirements for providing outdoor dining in City parking spaces in SRMC Chapter 11.70
(“Streetaries” Outdoor Eating Areas). The ordinance also amended sections of Title 14 (Zoning) of the
SRMC, removing references to the use of City parking spaces for Outdoor Dining but maintaining existing
requirements for “Sidewalk Dining”. Additionally, the City Council adopted Resolution No. 15136,
approving the Streetary Program Design, Development Standards, and Fees. Altogether, the revised
program allowed for phased compliance by merchants already operating Streetaries with the goal of full
program compliance by March 15, 2023.
The number of Streetaries in San Rafael has fluctuated since the pandemic's onset, and many have
fallen short of compliance due to new fee and insurance requirements. For example, twenty-nine (29)
merchants received Covid-era Temporary Outdoor Dining Permits, which were valid through November
30, 2022. In contrast, by January 2025, there were only nine (9) merchants operating a Streetary in San
Rafael. Of those nine (9), none complied with the new program fee, permit, or structure requirements that
were adopted in October 2022. In December 2023 and again in early 2025, staff communicated with
existing Streetary operators to assess challenges that hampered participation with the formalized 2022
Streetary program. Businesses identified challenges primarily related to the fee structure and insurance
requirements. Similarly, on May 20, 2025, the Mayor hosted a listening session for current and
prospective Streetary operators, during which businesses cited program fees and the costs associated
with bringing existing Streetary structures into compliance with design standards as primary impediments
to program participation and compliance.
ANALYSIS:
Though administrative costs, sources and levels of revenue, and community priorities can vary somewhat
among cities of different sizes, the below comparison of San Rafael’s fee amounts to those of the City of
Santa Rosa, the City of Oakland, and the Town of San Anselmo (Table 1) reveal that the current costs
associated with participating in the Streetary program in San Rafael are significantly greater than the
costs to participate in similar programs (permitted business utilization of street parking space(s) for
providing food service) in those cities.

While successful Streetary implementation varies based on individual site constraints, the key concern
from program participants has been the initial cost structure for application, permitting, deposit, and
annual fees. To address these barriers, the staff proposes revising the City’s Master Fee Schedule with

both permanent and temporary reductions in fee amounts and the establishment of a new fee category.
Below, the staff outlines the proposed revisions:
1.Streetary Permit Application Fee - Flat Fee (Table 2)
Reduce this one-time application fee to align with the Outdoor (Sidewalk) Dining Application Fee
(listed under the Planning category of the Master Fee Schedule ). This reduction will align the
permit fees for both programs, whose initial processing will be managed by the Planning Division.
2.Streetary Permit Deposit Fee - Flat Fee (Table 2)
Reduce this fee amount to $0 (reducing without elimination provides future flexibility in the event
a deposit is needed). This charge was designed to cover City expenses in the event an operator
did not remove a Streetary structure following closure. However, the deposit imposes a financial
barrier to businesses seeking to install a Streetary. The City can require businesses to remove a
Streetary structure as a condition to their encroachment permit. That said, there are potential
costs to the City if the owner abandons the Streetary structure or refuses to remove the structure,
in which case the City would have to remove the structure and absorb the cost.
3.Streetary Permit Encroachment Lease Fee - Flat Annual Fee (Table 2)
Staff recommends a two-year fifty percent (50%) reduction of this fee as an economic
development incentive. This temporary fee reduction will reduce the cost burden for Streetary
operators by lowering the overall cost for the next two years of Streetary operation. Based on
feedback from restaurant owners, reducing operational expenses for Streetary may increase
program participation, leading to increased business and subsequent tax revenue. To ensure that
new and existing program participants may benefit equally from this incentive program, t he
proposed resolution also authorizes the City to offer a fee credit to businesses that paid their fees
for fiscal year 2025-26 before the authorization of this incentive program. That fee credit may be
applied to their fees due in fiscal year 2026-27.
4.Streetary Permit Site Inspection & Insurance Review Fee - Flat Annual Fee (Table 2)
This new fee category will cover the cost of staff time needed for an annual Streetary site
inspection and insurance review. These annual checks by City staff are necessary to ensure
compliance with program standards and to review the operator’s insurance coverage, thereby
reducing liability and strengthening program communication. For cases in which there is a
Streetary and outdoor dining associated with one business, only one Site Inspection and
Insurance Review Fee will be required to address both requirements. Streamlining this process
reduces the amount of staff time required to complete this review and will lead to reduced staff
costs.
5.Outdoor (Sidewalk) Dining Site Inspection & Insurance Review Fee - Flat Annual Fee (Table
3)
This new fee category will cover the cost of staff time needed for annual sidewalk dining site
inspections and insurance review.

COMMUNITY OUTREACH:
Staff participated in a listening session hosted by the Mayor on May 20, 2025, for current and prospective
Streetary operators, during which businesses cited program fees and the City’s design standards as

barriers to participation and program compliance. In addition, the City provided notice of this public
hearing and the proposed update to the Master Fee Schedule, and information was made available to
the public in advance of the hearing in accordance with Government Code Sections 66016 through
66018. Following the recommended adoption of the Resolution (Attachment 1), staff will continue to
communicate with existing Streetary operators to notify them of the changes to program fees and assist
them with coming into full compliance with program requirements and standards.
ENVIRONMENTAL REVIEW:
The proposed action is exempt from the California Environmental Quality Act (CEQA) per CEQA
Guideline 15061(b)(3) in that it does not have the potential to significantly affect the environment.
FISCAL IMPACT:
If adopted as proposed, the fee amendments and temporary discount would result in an approximate
$15,053 reduction in fee revenue based on single parking space use. Under the current fee structure,
first-year revenue generated from Streetary permits is estimated at $41,216 (exclusive of deposits
currently required by operators). Under the proposed fee structure, including the proposed temporary
50% discount to the Encroachment Lease Fee, first-year revenue generated from Streetary permits is
estimated to be $26,162. An additional $310 per year would be assessed on permit holders for the new
Site Inspection/Insurance Review Fee, which would only be charged for annual renewal of a Streetary
permit or Outdoor Dining License.
OPTIONS:
The City Council has the following options to consider on each of the resolutions:
1. Adopt the resolution as presented.
2. Adopt the resolution with modifications.
3. Direct City staff to return to the City Council with more information.
4. Take no action.
RECOMMENDED ACTION:
Staff recommends that the City Council adopt a resolution revising “Streetary” and “Outdoor (Sidewalk)
Dining” fee categories, descriptions, and structures in the City’s Master Fee Schedule for fiscal year (FY)
2025-26 and authorizing economic incentives.

RESOLUTION OF THE SAN RAFAEL CITY COUNCIL REVISING “STREETARY” AND
“OUTDOOR (SIDEWALK) DINING” FEE CATEGORIES, DESCRIPTIONS, AND
STRUCTURES IN THE CITY’S MASTER FEE SCHEDULE FISCAL YEAR 2025-2026
AND AUTHORIZING ECONOMIC INCENTIVES
WHEREAS, in December 2022, following a comprehensive fee study, the City
Council adopted Resolution 15178, a resolution authorizing updates to its Master Fee
Schedule, which has subsequently been updated and reaffirmed through Resolution
15421; and
WHEREAS, on October 3, 2022, the City Council adopted Ordinance 2016, which
added Chapter 11.70 (“Streetaries”) to Title 11 of the SRMC, outlining requirements for
the provision of outdoor dining space in City parking spaces by restaurants; and
WHEREAS, on October 3, 2022, the City Council adopted Resolution 15136 which
established Streetary program fee amounts of $2,000 for a one-time Application Fee
(calculated at cost offset levels for staff time), $2,000 for a one-time Deposit held by the
City (if needed to pay for Streetary removal and reinstatement of the public right of way),
and a $3,600 Encroachment Lease Fee per parking space (calculated on the basis of
average annual revenue from parking meters downtown in 2019); and
WHEREAS, Resolution 15136 also established a timeline of periods during which
the Application Fee would be waived (until December 31, 2023), and the Encroachment
Lease Fee would be waived (until June 1, 2023) or discounted (50% between June 1,
2023 - May 30, 2024 and 25% between June 1, 2024 - May 30, 2025); and
WHEREAS, City staff propose revising the City’s “Streetary” and “Outdoor
(Sidewalk) Dining” fee categories, descriptions, and fee structures in order to reduce the
financial burden on current or prospective Streetary or Outdoor Dining program
participants and offering a companion credit to encourage economic activity and vitality;
and
WHEREAS, in December 2023 and again in early 2025, staff communicated with
eight Streetary operators to assess challenges that hampered participation with the
formalized 2022 Streetary program, and those operators identified challenges primarily
related to the fee structure and insurance requirements; and
WHEREAS, on May 20, 2025, the Mayor hosted a listening session for current and
prospective Streetary operators, during which businesses cited program fees and the
costs associated with bringing existing Streetary structures into compliance with
standards as primary impediments to program participation and compliance; and
WHEREAS, City staff calculated the fee amounts identified in Exhibit A (and
described in the staff report accompanying this resolution) based upon stakeholder
feedback and in accordance with the requirements of State law; and,
WHEREAS, the proposed revised Streetary fees do not qualify as a “tax” as set
forth in Proposition 26 (California Constitution Article XIII C, Section 1(e)) since the fee
amounts: (a) do not exceed the proportionate reasonable cost to the City in providing the
service or program to the person paying the fee, and (b) do not exceed the value of City
property used by the person paying the fee.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of San
Rafael does hereby approve and authorize the revision of “Streetary” and “Outdoor
(Sidewalk) Dining” fees in the Fiscal Year 2025-2026 Master Fee Schedule, as reflected
in Exhibit A attached hereto, to be effective immediately and hereby authorizes the City
Manager or designee to apply a 50% discount to the encroachment lease fee as an
economic incentive for Fiscal Year 2025-26 and 2026-27 and for those businesses that
have already paid the higher fees, to offer a credit on their fees for Fiscal Year 2026-27
that does not exceed the delta between the amount of the fee paid and the fee for Fiscal
Year 2025-26.

1 . Public Records Request fees may be waived at the City's sole discretion for requests totaling fewer than 50 pages per request.
2. Temporary Encroachment Permit Fees: there is no charge for debris boxes if placed on private property.
4. Fee is per review. Fee may be charged several times if there are multiple reviews of the project.
Deposit + Hourly = Applicant is to pay all City costs, including FBHR based on the time staff spends on the project, 100% of consultant costs,
which include but not limited to environmental conultants, archaeologists, outside legal councel, contract planners, etc. and materials. The initial
deposit is listed in the Fee Column.
3. PW Review of Building & Planning Permit - All planning and building permit submissions may be referred to third-party review by an external consultant or the City
Surveyor at the discretion of Department of Public Works staff. The applicant is responsible for reimbursement of any fees accrued by external consultants or City Surveyor.
