Minutes and Notice of Decision
(Pursuant to San Rafael Municipal Code 14.28.050)
10:00 -10:09 am 1. 3255 Kerner Boulevard - Request for a Use Permit to operate a

PERMITS REQUIRED
• Use Permit (UP25-002) Pursuant to San Rafael Municipal Code (SRMC) Section
14.05.020, a Conditional Use Permit approved by the Planning Commission is
required for religious institutions in the General Commercial (GC) zoning district. Per
14.22.020 B. the director has the authority to delegate from Planning Commission to
Zoning Administrator. The proposed use has been deemed to be an insignificant or
inconsequential change in use as it is just changing suites. Has previously gone
through Planning Commission in 2017 for a conditional use permit (UP17-013) under
suite 2. The use will not have a detrimental impact on surrounding properties and is
not a use warranting the designated level of review, the use permit application has
been delegated to the Zoning Administrator.
PROJECT DESCRIPTION
The project proposed to operate a church within the existing building at 3255 Kerner
Boulevard in Suite 6. The suite has a total of 690.1 square feet of rentable space whereas in
suite 2 they had 521 square feet on the second floor of the building. The proposed church will
operate Sundays from 10:00 am to 1:00 pm and Tuesday, Thursday, and Fridays from 7:00
pm to 9:30 pm. The selected service days are Sunday, Tuesday, and Fridays. While
Thursdays are intended for prayer service, which is the only additional service provided from
the previously approved use permit. It is estimated that the average congregation will be 18
to 25 people attending services.
There is no proposed construction associated with this relocation. The transition will primarily
involve the transfer of furniture, equipment, and interior setup adjustments to accommodate
the church’s needs. No modifications to the building’s exterior, structural elements, or parking
arrangements are planned.

PUBLIC HEARING
On March 26, 2025, a Zoning Administrator meeting was convened for this Conditional
Use Permit (UP25-002). The Acting Zoning Administrator for this meeting, Michaela
O’Brien, opened the meeting at 10:00 am.
A. Planner Presentation
The Project Planner gave a brief presentation on the proposed project and findings for
approval.
B. Applicant presentation
The applicant was present at the hearing and gave a brief follow-up presentation of the
project.
C. Public Comments
There were no members of the public present during the meeting, nor did staff receive
any public comment.
D. ZA discussion
The Zoning Administrator briefly discussed the project and confirmed the hours of
operation. The Zoning Administrator confirmed the hours of operation are purely for
service hours when people will be coming in and out of space. Outside of those hours will
be minor administrative actions.
E. Action
The Zoning Administrator Conditionally Approved the request for a Use Permit (UP25-
002).
These conditions of approval are listed below and included as part of the Zoning
Administrators decision.
The meeting was adjourned at 10:09 am.
This Notice of Zoning Administrator decision is provided in compliance with SRMC
Section 14.28.050 - Notice of decision. Any aggrieved party may appeal this decision
pursuant to SRMC Section 14.28.030 - Filing and time limit of appeals, by submitting a
letter of appeal and the appropriate fees within five (5) working days of the date of
approval, or by April 2, 2025 at 5:00 p.m. This approval shall become effective at the
end of the appeal period.

Once a permit approval has been implemented/established in compliance with all City
requirements, it shall run with the land and be valid for the time period specified; e.g.,
duration of the project/use.
