Public Convenience or Necessity (PCN) findings to grant a Department of Alcoholic Beverage (ABC) type 40 and 42 license(s) at “Flyte” Racquet Club; APN: 115-230-12; San Rafael Airport Planned Development District (PD1909-WO); PLAN24-176 / PCN24-002 Project Planner: Jose M. Herrera-Preza, Principal Planner PERMITS REQUIRED • Public Convenience or Necessity (PCN24-176). Pursuant to San Rafael Municipal Code (SRMC) Section 14.22.080, City Council Resolution 10299, and City Council Resolution 13479 outline the approval of the Master Use Permit permitting the sale of alcoholic beverages and identify the review criteria for all off-sale or on- sale liquor license applications that require a local determination of public convenience or necessity as a condition of issuance of the ABC license due to over concentration of licenses within the census tract. Therefore, a Zoning Administrator Use Permit is required to make a decision to find public convenience or necessity will be served upon consideration of the criteria established in the findings. PROJECT DESCRIPTION The application consists of a request to add an Alcoholic Beverage Control (ABC) license type 40 and 42 to “Flyte” Racquet Club at the San Rafael Airport Sports Center. Pursuant to City Council Resolution 13479 the site was granted a condition of approval (No. 50) to have beer and wine beverage service at the facility pending an ABC license. Planning entitlements ED05-015/UP05-08 specifically considered the activity as an ancillary use to a café/dining food service area and limited alcohol consumption to specific areas of the facility. The applicant intends to comply with the limitations imposed in the condition of approval. PUBLIC HEARING On February 12, 2025, a Zoning Administrator meeting was convened for this Public Convenience or Necessity (PCN24-176). The Acting Zoning Administrator for this meeting, Renee Nickenig, opened the meeting at 10:00 am. ZA Minutes and Notice of Decision February 12, 2025 2 A. Planner Presentation The Project Planner gave a brief presentation on the proposed project and findings for approval. B. Applicant presentation The Applicant was not present at the meeting. C. Public Comments No public comments were received prior to the hearing or during. D. ZA discussion The Zoning Administrator briefly discussed the project and confirmed the findings and conditions for approval. E. Action The Zoning Administrator Conditionally Approved the request for an Public Convenience or Necessity (PCN24-176). These conditions of approval are listed below and included as part of the Zoning Administrators decision The meeting was adjourned at 10:18 am. This Notice of Zoning Administrator decision is provided in compliance with SRMC Section 14.28.050 - Notice of decision. Any aggrieved party may appeal this decision pursuant to SRMC Section 14.28.030 - Filing and time limit of appeals, by submitting a letter of appeal and the appropriate fees within five (5) working days of the date of approval, or by February 20, 2025 at 5:00 p.m. This approval shall become effective at the end of the appeal period. Once a permit approval has been implemented/established in compliance with all City requirements, it shall run with the land and be valid for the time period specified; e.g., duration of the project/use.
