HomeMy WebLinkAboutOrdinance 175 (Electrical Code)CHARTER ORDINANCE NO. / 76,- AN ORDINANCE TO BE KNOWN AS THE ELECTRICAL CODE OF THE CITY OF SAN RAFAEL CREATING THE OFFICE OF CITY ELECTRICAL IN- SPECTOR, PRESCRIBING HIS DUTIES, PROVIDING FOR THE ISSU- ANCE OF ELECTRICAL PERMITS AND FOR INSPECTIONS AND FIXING THE FEES THEREFOR; REGULATING THE INSTPJ LATION, ARRANGE- MENT, ALTERATION, REPAIR, MAINTENANCE AND OPERATION OF ELECTRIC WIRING, ELECTRIC FIXTURES, AND OTHER ELECTRIC APPLIANCES AND EQUIPMENT IN THE CITY OF SAP? RAFAEL; PRO- VIDING A PENALTY FOR THE VIOLATION OF THE SAME AND ADOPT- ING THE STANDARD ELECTRICAL CODE PUBLISHED BY THE PACIFIC COAST ELECTRICAL BUREAU BY REFERENCE. The City Council of the City of San Rafael do ordain as follows: Section 1: CITY ELECTRICAL INSPECTOR- Qualifications: There is hereby created and established the office of City Electrical Inspector. The person chosen to fill the office of City Electrical In- spector shall be of good moral character, and shall be well versed in approved methods'of electrical construction for safety to life and pro- perty, the statutes of the State of California relating to electrical work, the electrical rules and regulations issued under authority of the statutes governing industrial installations, the National Electrical Code as approved by the American Standards Association, and electrical rules of the Board of Fire Underwriters of the Pacific. Appointment, Salary, Etc.: Said City Electrical Inspector shall be appointed by the City Council. He shall received a salary as determined by the City Council. The City Electrical Inspector shall also take and subscribe an oath which together with the certificate of his appointment shall be filed with the City Clerk. He shall be removed from office for cause only, after a full bearing, by the City Council. It shall be unlawful for the City Electrical Inspector to engage in the business of the sale, installation or the maintenance of electric wiring, electric devises and electric mater- - 1 - ial either directly or indirectly and he shall have no financial interests. in any concern engaged in such business in the City of San Rafael at any time while holding office of City Electrical Inspector. Any violation of the provisions of this .section by said City Electrical Inspector shall be sufficient cause for his removal from office but he may be removed for other Just cause. The City Electrical Inspector shall appoint, by and with the advice and consent of the City Council such assistant inspectors as are deemed necessary by said City Electrical Inspector. Section 2: All that certain electrical code entitled, 'Standard Electrical Code, Published by the Pacific Coast Electrical Bureau, Endorsed by the Southwestern Section International Association of Electrical In- spectors 1932", three copies of which in printed book form have been filed and are now on file in the office of the City Clerk of said City marked as having been filed therein on the Z8—day of August, 1933, for use and examination by the public,excepting Section 9 thereof and excepting Subdivision C of Section 17 thereof is hereby adopted as the Standard Electrical Code of and for the City of San Rafael, to which reference is hereby made with like effect as if all of the provisions and printed matter therein were herein set forth in full. Section 3: Except as hereinabove excepted all of the pages, titles, printed matter, indexes, parts, chapters, paragraphs, sections, subsections, subdivisions, provisions, regulations and penalties therein provided and contained are hereby adopted as the rules and regulations for the government and regulation of the installation, arrangement, alteration, repair, main- tenance and operation of the electrical wiring, electric fixtures and other electric appliances and equipment in said City. Section 4: In lieu of the schedule of fees provided by Section 9 of said Standard Electrical Code there is hereby adopted the following sched- ule of fees which are hereby fixed as the fees which shall be paid upon - 2 - the issuance of a permit for the work permitted thereby, to -wit -,- SCHEDULE OF FEES': Any person, firm, corporation or political sub -division to whom a permit for doing electrical work has been g ranted shall pay the following fees to the City Electrical Inspector or other designated authority at the time the permit is granted, to -wit: For issuing permits, each 0 .75 For sockets or outlets at which current is used or controlled which are installed at a distance not exceeding 18 inches from each other, each .022 For sockets or outlets at which current is used or controlled which are installed at a distance exceeding 18 inches from each other, each .05 For installation of each fixture .05 For each radio outlet .05 For eack pern,anont radio antennae .os For each motor of not more than 2 h.p. .25 For each motor of not more than 2 h.p. but more than 2 h.p. .50 For each motor of not more than 5 h.p, but more than 2 h.p. .75 For each motor of not more than 15 h.p. but more than 5 h.p. 1.25 For each motor of not more than 50 h.p. but more than 15 h.p. 1.75 For each motor of not more than 200 h.p. but more than 50 h.p. 2.50 For each motor of more than 200 h.p. 5.00 For each mercury arc lamp and equipment 1.00 For each projection machine, dissolver, etc. 1.00 For .each range or heater installation .25 For electric signs, each 1.00 For each mercury are rectifie(r and synchronous converter, per K.W. .25 - a For each extra inspection made necessary by defective workmanship or materials For the inspection of any electrical equip- ment for which no fee is hereby prescribed there shall be charged a fee per hour of Upon failure to make application and take out a permit by the second work day after commenc- ing work the permit fee and the inspection fees shall be twice the regular amount. No permit shall be issued to any person, firm or corporation or political sub -division unless all fees due are paid in full. Failure to take out a permit and pay the fees: therefor within 72 hours after commencing work shall be deemed evidence of violation of the pro- visions of this Code. 0 1.00 2.00 Section 5: In lieu of Subdivision C of Section 17 of said Standard Electrical Code the following is hereby adopted: C. Flexible conduit shall not be used unless approved by the City Electrical Inspector. In partitions with studs less than 22 inches in width wire shall be incased in rigid conduit. Section 6: Said City Electrical Inspector shall have all of the powers and duties provided in said Standard Electrical Code. Section 7: The penalties for violation of any of the provisions of this Ordinance or of said Standard Electrical Code shall be as expressed and provided in said Code and in lieu of the City Jail men- tioned in Section'27 of said Code the County Jail of the County of Marin is hereby fixed as the place of imprisonment for violation of said Code. Section 8: Eaah of the matters and things in said Code declared to be unlawful or in violation thereof is hereby declared to be unlawful and in violation of said Code. Section 9: All ordinances and parts of ordinances in conflict herewith are hereby repealed. - 4 - Section 10: This ordinance shall be published once in full before its final passage in the Marin Journal, a weekly newspaper printed, published and circulated in said City and shall be in full force and effect thirty days from and after its final passage.
