HomeMy WebLinkAboutOrdinance 306 (Electrical Code)CHARTER ORDINANCE I10.30k AN ORDINANCE TO BE KNOIFN AS THE ELECTRICAL CODE OF THE CITY OF SAN RAFAEL, CREATING THE OFFICE OF CHIEF ELECTRICAL INSPECTOR, PRESCRIBING HIS DUTIES, PROVIDING FOR THE ISSUANCE OF ELECTRICAL PERT,IITS AVID FOR ITuSPECTIONS A1,TD FIXIH,G THE FEES 'THEREFOR; REGU- LATING THE INSTALLATIOI.4, ARRANGE1.1'ENT, ALTERATION, REPAIR, I:IAIN- TENANCE AND OPERATIOII OF ELECTRIC WIRING, ELECTRIC FIXTURES, AND OTHER ELECTRIC APPLIANCES AND EQUIPI:IEI"IT IN THE CITY OF SALT RAFAEL; PROVIDING A PE TIALTY FOR THE, VIOLATION OF THE SAI,IIE AND ADOPTING THE UNIFORI,II ELECTRICAL CODE PUBLISHED BY THE PACIFIC COAST ELECTRICAL BUREAU BY REFERENCE; AUTHORIZING THE CHIEF ELECTRICAL INSPECTOR TO ADOPT AND ENFORCE INTERIM* REVISIONS TO THE 1940 EDITION OF THE NATIONAL ELECTRICAL CODE DURILIG THE NATIONAL L11'.ERGENCY BY AMENDING SUB -SECTION D, SECTION 8, AND REPEALING ALL ORDINANCES IN COTIT=ICT HERE71ITH, The City Council of the City of San Rafael, California, do hereby ordain as follows: SECTION 1: Chief Electrical In 2 ctor;Creation. There is hereby created and established the office of CHIEF ELECTRICAL INSPECTOR for the City of San Rafael, California, whose authority and duties shall be as set forth and contained in the Uniform ;electrical Code herein- after adopted by 'reference. SECTION 2: All that certain "Uniform Electrical Code" so en- titled, published by the Pacific Coast Electrical Bureau, 1941 Edition, three copies of ;,which, in printed book form, have been filed and are now on file in the Office of the City Clerk of said City marked "filed" therein on the 25th day of June, 1942, for use and examination by the public, is hereby adopted as the Uniform Electrical Code of and for the City of San Rafael, California, to which reference is hereby made with like effect as if all of the provisions and printed matter therein were herein set forth in full, excepting, however, that the words"a competent electrician" appearing in lines 3 and 4 of Section 1 of said Code, shall be and they are hereby deleted from said Code and the Chief Electrical Inspector therein and herein provided need not be a competent electrician. MARTINELLI & GARDINER ATTORNEYS AT LAW 41B ALBERT BUILDING BAN RAFAEL, CALIF. -1- SECTION 3: Except as hereinabove excepted all of the pages, titles, printed matter, indexes, parts, chapters, paraCD graphs, sec- tions, subsections, subdivisions, provisions, regulations and penal- ties therein provided and contained are hereby adopted as the rules and regulations for the government and regulation of the installation, arrangement, alteration, repair, maintenance and operation of the electrical wiring, electric fixtures and other electric appliances and equipment in said city. SECTION 4: The penalties for violation of any of the provisions of this Ordinance or of said Uniform Electrical Code shall be as ex- pressed and provided in said Code and in lieu of the City Jail men- tioned in Section 23 of said Code tl-ie"County Jail of the County of I1larin is hereby fixed as the place of imprisonment for violation of said Code. SECTION 5: Each of the matters and things in said Code declared to be unlawful or in violation thereof is hereby declared to be unlaw- ful and in violation of said Code. SECTI011 6: Charter Ordinance 'o. 175, Charter Ordinance 'No. 284 and all ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 7: Subsection D, Section 8 of said Uniform Llectrical Code shall be and is hereby amended to authorize the Chief Electrical Inspector to adopt and enforce such interim revisions to the 1940 Edi- tion of the National Electrical Code as may be adopted during the present war emergency. SECTION 8: This ordinance is intended as an emergency ordinance and shall therefore be in full force and effect immediately upon its final passage. Said emergency is hereby declared to consist in the following facts, to wit: a state of war exists between the United States of America and other nations by reason ,�rhereof certain Federal regulations have been adopted and certain provisions of the National MARTINELLI & GARDINER ATTORNEYS AT LAW 418 ALBERT BUILDING SAN RAFAEL, CALIF. -2- Electrical Code have been and are continuously being made restrict- ing the use of certain critical materials provided by said Uniform Electrical Code and National Electrical Code and it is necessary that full force and effect be immediately given to -said regulations and revisions and it is necessary that a supplemental emergency ordi- nance be concurrently adopted ivith this Ordinance by reason whereof 'this Ordinance should take effect without delay.
